21.3 The provisions of paragraphs 21.1 and
21.2 shall not affect the parties rights or
remedies in relation to any fraud or
fraudulent misrepresentation.
21.4 A person who is not party to this
Contract has no right under the Contracts
(Rights of Third Parties) Act 1999 to
enforce any term of this Contract, but this
does not affect any right or remedy of a
third party which exists or is available
apart from that Act.
22. SEVERABILITY
If any provision of this Contract is held
invalid, illegal or unenforceable for any
reason by any court of competent
jurisdiction, such provision shall be
severed and the remainder of its
provisions will continue in full force and
effect as if this Contract had been
executed with the invalid, illegal or
unenforceable provision omitted.
23. LAW AND JURISDICTION
This Contract is governed by the law of
England and Wales and both parties
submit to the exclusive jurisdiction of the
English Courts.
ANNEX A
SCHEDULE OF SERVICE
We will:
Provide 24x7 support for the Service,
this support can be accessed by calling 0870
240 1979 (call charges apply) or by emailing
bthomemonitoring-support@bt.com
Make all reasonable efforts to alert You and your
nominated contacts to events detected by
Equipment using the Service, by referring to the
instructions given in the personal online account.
You must:
Ensure that Equipment is in full working order
and is not subjected to any unauthorised
modifications.
Ensure personal online account information is
kept up to date for the Service to operate
correctly.
Ensure that the telephone line, which is
connected to the Equipment, is operational in
order for the Equipment to communicate with
the Service. Call barring of 0870 numbers will
prevent the Equipment from dialling the Service.
Obtain permission or at least notify contacts of
their nomination, and brief them on how to
respond to messages from the Service.
Remove a nominated contact if a complaint is
received.
Not abuse the Service by sending excessive
messages to yourself or contacts.
