Emission Control System Warranty Statement
(Owner's Defect Warranty Rights and Obligations)
TheU.S.EPAand MTDarepleasedto explaintheemissionscontrolsystemwarrantyonyour modelyear 2005and latersmalloff-roadengine.
Newsmalloff-roadenginesmustbe designed,builtandequippedto meetthe stringentanti-smogstandards.MTDmustwarrantythe emission
controlsystemonyourenginefortheperiodoftimelistedbelow,providedtherehasbeennoabuse,neglector impropermaintenanceofyoursmall
off-roadengine.
Youremissioncontrolsystemmayincludepartssuchasthecarburetor,aircleaner,ignitionsystem,exhaustsystem,andotherassociatedemis-
sion-relatedcomponents.
Wherea warrantableconditionexists,MTDwill repairyoursmalloff-roadengineat nocost to yourincludingdiagnosis,partsand labor.
MANUFACTURER'S WARRANTY COVERAGE:
Thisemissionscontrolsystemiswarrantedfortwoyears.If anyemission-relatedpartonyourengineisdefective,thepartwillberepairedor
replacedbyMTD.
OWNER'S WARRANTY RESPONSIBILITIES:
Asthesmalloff-roadengineowner,youare responsibleforthe performanceofthe requiredmaintenancelistedinyourOwner'sManual.MTD
recommendsthatyouretainall yourreceiptscoveringmaintenanceson yoursmalloff-roadengine,but MTDcan not denywarrantysolelyfor the
lackofreceiptsor foryourfailureto ensuretheperformancetoallscheduledmaintenance.
Asthesmalloff-roadengineowner,youshouldhoweverbeawarethat MTDmaydenyyourwarrantycoverageifyoursmalloff-roadengineorpart
hasfaileddue toabuse,neglect,impropermaintenanceor unapprovedmodifications.
Youare responsiblefor presentingyour smalloff-roadengineto an AuthorizedMTDServiceDealerassoonasa problemexists.Thewarranted
repairsshouldbe completedina reasonableamountof time,nottoexceed30 days.

DEFECTS WARRANTY REQUIREMENTS FOR 1995 AND LATER SMALL OFF-ROAD ENGINES:
Thissectionappliesto 1995andlater smalloff-roadengines.The warrantyperiodbeginsonthe datethe engineor equipmentisdeliveredtoan
ultimatepurchaser.
(a) GeneralEmissionsWarrantyCoverage_
MTDmustwarranttotheultimatepurchaserandeachsubsequentpurchaserthatthe engineis:
(1)Designed,built,andequippedsoas to conformwithallapplicableregulationsadoptedby the AirResourcesBoardpursuantto itsauthorityin
Chapters1and2,Part5, Division26of theHealthandSafetyCode;and
(2) Freefromdefectsin materialsandworkmanshipthatcausethe failureof a warrantedpartto beidenticalin all materialrespectsto the partas
describedin theenginemanufacturer'sapplicationforcertificationfora periodof twoyears.
.(b)Thewarrantyonemissions-relatedpartswill be interpretedas follows:
(1)Anywarrantedpartthatis notscheduledfor replacementas requiredmaintenanceinthe writteninstructionsrequiredby Subsection(c)
mustbewarrantedforthe warrantyperioddefinedinSubsection(a)(2). Ifany suchpartfailsduringtheperiodof warrantycoverage,it mustbe
repairedor replacedby MTDaccordingto Subsection(4)below.Anysuchpart repairedor replacedunderthewarrantymustbewarrantedfor
theremainingwarrantyperiod.
(2)Anywarrantedpartthat is scheduledonlyfor regularinspectioninthe writteninstructionsrequiredby Subsection(c) must bewarrantedfor
thewarrantyperioddefinedin Subsection(a)(2).A statementinsuchwritteninstructionstothe effectof "repairor replaceasnecessary"will
notreducethe periodof warrantycoverage.Anysuchpart repairedor replacedunderwarrantymustbe warrantedforthe remainingwarranty
period.
(3) Anywarrantedpartthat whichisscheduledfor replacementas requiredmaintenancein thewritteninstructionsrequiredbySubsection(c)
mustbewarrantedforthe periodof timepriortothefirst scheduledreplacementpointforthat part.Ifthe part failspriorto thefirst scheduled
replacement,thepart mustbe repairedor replacedby MTDaccordingto Subsection(4) below.Anysuchpart repairedor replacedunder
warrantymustbewarrantedfortheremainderof the periodpriorto the first scheduledreplacementpointfor the part.
(4) Repairor replacementofany warrantedpartunderthewarrantyprovisionsof thisarticlemustbe performedatnochargeto the ownerat a
warrantystation.
(5) Notwithstandingthe provisionsof Subsection(4)above,warrantyservicesor repairsmustbe providedat all MTDdistributioncentersthat
arefranchisedto servicethesubjectengines.
(6) Theownermustnotbechargedfordiagnosticlaborthatleadsto thedeterminationthata warrantedpartis in factdefective,providedthat
suchdiagnosticworkis performedat a warrantystation.
