Receiver
Warranty
Phorus,
as the manufacturer, provides a one-year
limited manufacturer's warranty
to
the
original purchaser
of
the
Phorus
PAS
Receiver
(the
"Product',
from the date
of
original purchase
("Warranty").This
Warranty provides you certain
legal
rights and you may have
additional
protections under your
local laws. Please
keep your receipt
or
bill
of
sale
to
preserve your warranty rights.
Warranty
Applicability:
This Warranty covers
all
defects
in
material and workmanship
of
the
Product
under
normal
use. For
all properly and
timely
submitted warranty claims, including
a
copy
of the
original
receipt
or
bill
of
sale, Phorus will
either
(i)
repair the defect at no charge, using new parts
or
refurbished parts that are
equivalent
to
new
in
performance and
reliability;
(ii)
exchange the
Product
with a product that is new
or
refurbished that is
equivalent
to
new
in
performance and
reliability
and is at
least functionally equivalent
to
the original
Product;
or
(iii)
refund the purchase price
of
the
Product. Phorus
may request that you
replace defective parts with
user-installable
new
or
refurbished parts that
Phorus
provides
in
fulfillment
of
its warranty obligation. A replacement product
or
part,
including a user-installable
part that has been installed
in
accordance with instructions provided by
Phorus, assumes the remaining warranty
of
the
original Product
or
90 days from the date
of
replacement
or
repair, whichever provides
longer
coverage
for
you. When a
Product
or
part is exchanged, any replacement item becomes your property and the
replaced
item becomes
Phorus'
property.
Warranty
Eligibility: Original U.S.-Iocated
purchasers
of
the
Product having purchased the
Product
from
an
authorized
U.S.-Iocated retailer
of
Phorus
products are
entitled
to
certain rights under this
Warranty as defined herein. For warranty service outside
of
the U.S., please
contact your
local Phorus
product
retailer. Proof
of
purchase is
also
required as part
of
the making a warranty
claim. Please
retain your receipt or bill
of
sale
evidencing your purchase.

PRODUCT TO
THE
RETAILER
FOR
WARRANTY
SUPPORT.
Warranty
Exclusions:
Phorus does not warrant that the
Product will
operate without interruption
or
that the
Product
will operate error-free,
or
that all errors are capable
of
being
or
will be corrected by
Phorus.
External conditions out
of
the control
of
Phorus
may affect the
overall
performance
of
the
Product, including
without limitation, network configuration, network performance, distances between
the
Product
and the network connection and/or content sources, other third party devices
utilization
of
the network, or general environmental radio interference with the
Product. This Warranty does not
cover damages
or
defects
(i)
caused
by
abuse, accident, casualty, misuse, unreasonable use
or
neglect;
(ii)
resulting
from failure
to
follow usage instructions;
(iii)
to
a
Product
or
part that has been
modified
to
alter
functionality
or
capability without the written permission
of
Phorus;
(iv)
to
any decorative
or
cosmetic surface
or
exterior;
(v)
to
any
Product
on which the serial number has been effaced,
modified
or
removed;
(vi)
to
Products
used for other than personal home use;
(vii)
occurring during shipment; (viii) occurring
by
repairs performed by a repair service not previously approved
or
authorized
by
Phorus; and
(iv)
caused by your
failure
to
implement
any bug fixes
or
error corrections
to
the
Product
which are made
available
by Phorus. All
repairs
to
or
replacement
of
Products
subject
to
improperly
or
untimely-submitted warranty claims will be the responsibility
of
the claimant.
The
claimant
will pay all shipping charges for the shipment
of
the
Product
to
Phorus'
repair service
location.
Phorus
will pay reasonable return shipping charges for the return
of
the
Product
to
the claimant within the U.S.
Phorus
is not responsible for any damages caused by claimant's improper
packaging
or
shipment
of
the
Product
to
Phorus'
repair service
location.
This Warranty does not cover the cost
of
installation
or
removal
of
installation,
normal
set-up
or
adjustments
claims
based on
misrepresentation
by
the seller
or
performance variations
resulting
from installation-related circumstances such as source quality
or
AC power.
Voiding
Warranty:
All repairs
of
Products
must be done by a Phorus-authorized repair service. ·Any repairs performed by a repair service not
previously
approved
or
authorized by
Phorus
will void this
Warranty. Do not open the Product unless
authorized by
Phorus.
Opening the casing
of
the
Product
(not its packaging)
will
void this Warranty and may cause damage that is not covered by this
Warranty. Only Phorus
or
Phorus'
repair service should perform service on the
Product.
LIMITATIONS OF APPLICABLE WARRANTIES: TO
THE EXTENT
PERMITIED BY
LAW,
THIS
WARRANTY AND THE
REMEDIES SET FORTH ABOVE
ARE
EXCLUSIVE
AND
IN
LIEU
OF
ALL
OTHER
WARRANTIES, REMEDIES AND
CONDITIONS, WHETHER
ORAL, WRITIEN,
STATUTORY,
EXPRESS OR IMPLIED.
ALL
STATUTORY
AND
IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION,
WARRANTIES OF
MERCHANTABILITYAND FITNESS FOR PARTICULAR PURPOSE
ARE HEREBY LIMITED TO
THE TERMS AND
CONDITIONS AS SET FORTH HEREIN, UNLESS SUCH LIMITATIONS
ARE
PROHIBITED
BY
APPLICABLE
LAW.
LIMITATIONS OF REMEDIES
AND
LIABILITIES: PHORUS' TOTAL
AND AGGREGATE
LIABILITY
FOR
ALL
CLAIMS ARISING
HEREUNDER AND ANY AND ALL
APPLICABLE WARRANTIES
AT
LAW
ARE
LIMITED TO
THE
REPAIR OR REPLACEMENT OF ANY
DEFECTIVE PRODUCT, AS
DETERMINED
IN
PHORUS' DISCRETION, AND ALL
INCIDENTIAL
AND
CONSEQUENTIAL DAMAGES ARE
HEREBY EXCLUDED,
UNLESS SUCH LIMITATIONS
AND
EXCLUSIONS
ARE
PROHIBITIED
BY
APPLICABLE
LAW.
