Warranty
The seller grants the buyer, if he is a consumer, the statutory warranty in accordance with
the legal requirements for a period of 2 years from the purchase of the item. The Seller‘s
warranty obligations shall initially be limited to subsequent performance, whereby the
Seller shall be free to choose whether to deliver a defect- free item or to repair the defective
item. If subsequent performance is unsuccessful, the buyer shall be entitled to the further
statutory claims. The seller rejects warranty claims for damage caused by accident,
obviously incorrect use, misuse or improper transport; which occurred as a result of repairs
carried out by unauthorised personnel; which occurred as a result of use and handling not in
accordance with the operating instructions; which occurred as a result of improper handling
of the purchased item. Furthermore, claims for damages by the purchaser are excluded.
Excluded from this are claims for damages by the buyer arising from injury to life, limb or
health as well as liability for other damages based on an intentional or grossly negligent
breach of duty by the seller, his legal representatives or vicarious agents. Also unaffected is
the liability for breaches of duty, the fulfilment of which makes the proper execution of the
contract possible in the first place and on the observance of which the buyer may regularly
rely. In the event of a slightly negligent breach of such contractual obligations, the Seller
shall only be liable for the foreseeable damage typical for the contract, unless it is a matter
of claims for damages by the Customer arising from injury to life, limb or health.
