TheCleanAirAct1993andSmokeControlAreas

UndertheCleanAirActlocalauthoritiesmaydeclarethewholeorpartofthedistrictofthe
authoritytobeasmokecontrolarea.Itisanoffencetoemitsmokefromachimneyof
abuilding,
fromafurnaceorfromanyfixedboileriflocatedinadesignatedsmokecontrolarea.Itisalsoan
offencetoacquirean"unauthorisedfuel"forusewithinasmokecontrolareaunlessitisusedinan
"exempt"appliance("exempted"fromthecontrolswhichgenerallyapplyin
thesmokecontrolarea).

TheSecretaryofStateforEnvironment,FoodandRuralAffairshaspowersundertheActto
authorisesmokelessfuelsorexemptappliancesforuseinsmokecontrolareasinEngland.In
ScotlandandWalesthispowerrestswithMinistersinthedevolvedadministrationsforthose
countries.
Separatelegislation,theCleanAir(NorthernIreland)Order1981,appliesinNorthern
Ireland.Thereforeitisarequirementthatfuelsburntorobtainedforuseinsmokecontrolareas
havebeen"authorised"inRegulationsandthatappliancesusedtoburnsolidfuelinthoseareas
(otherthan"authorised"fuels)have
beenexemptedbyanOrdermadeandsignedbytheSecretary
ofStateorMinisterinthedevolvedadministrations.

YourlocalauthorityisresponsibleforimplementingtheCleanAirAct1993includingdesignationand
supervisionofsmokecontrolareasandyoucancontactthemfordetailsofCleanAirAct
requirements.

Commission/Handover

Ensureloosepartsarefittedinaccordancewiththeinstructionsfor“Assembly”givenabove.
Oncompletionoftheinstallationallowasuitableperiodoftimeforanyfirecementandmortarto
dryout,whenasmallfiremaybelitandcheckedtoensurethesmokeandfumesare
takenfromthe
stoveupthechimneyandemittedsafelytoatmosphere.Donotrunatfulloutputforatleast24
hours.
Oncompletionoftheinstallationandcommissioning,ensurethatthisinstallationandoperation
manualforthestoveisleftwiththecustomer.Ensurethatthecustomerisaware
ofthecorrectuse
oftheappliancewiththefuelslikelytobeusedonthestoveandwarnthemtouseonlythe
recommendedfuelsforthestove.
Advisetheuserwhattodoshouldsmokeorfumesbeemittedfromthestove.Thecustomershould
bewarnedto
useafireguardtoBS6539inthepresenceofchildren,agedand/orinfirmpersons.
Advisetheusernottofitanextractorfaninthesameroo masthestove,asthiscancausethestove
toemitfumesintotheroom.

