1.DefectsordamageresultingfromuseoftheProductin
otherthanitsnormalandcustomarymanner.
2.Defectsordamagefrommisuse,accident,water,orneglect.
3.Defectsordamagefromimpropertesting,operation,
maintenance,installation,alteration,modication,or
adjustment.
4.Breakageordamagetoantennasunlesscauseddirectlyby
defectsinmaterialworkmanship.
5.AProductsubjectedtounauthorizedProductmodications,
disassemblesorrepairs(including,withoutlimitation,
theadditiontotheProductofnon-MOTOROLAsupplied
equipment)whichadverselyaffectperformanceofthe
ProductorinterferewithMOTOROLA'snormalwarranty
inspectionandtestingoftheProducttoverifyanywarranty
claim.
6.Productwhichhashadtheserialnumberremovedormade
illegible.
7.Rechargeablebatteriesif:
a.anyofthesealsonthebatteryenclosureofcellsare
brokenorshowevidenceoftampering.
b.thedamageordefectiscausedbychargingorusing
thebatteryinequipmentorserviceotherthanthe
Productforwhichitisspecied.
8.Freightcoststotherepairdepot.
9.AProductwhich,duetoillegalorunauthorizedalterationof
thesoftware/rmwareintheProduct,doesnotfunctionin
accordancewithMOTOROLA’spublishedspecicationsor
theFCCcerticationlabelingineffectfortheProductatthe
timetheProductwasinitiallydistributedfromMOTOROLA.
10.ScratchesorothercosmeticdamagetoProductsurfaces
thatdoesnotaffecttheoperationoftheProduct.
11.Normalandcustomarywearandtear.
VI.PATENTANDSOFTWAREPROVISIONS:
MOTOROLAwilldefend,atitsownexpense,anysuitbrought
againsttheenduserpurchasertotheextentthatitisbased
onaclaimthattheProductorpartsinfringeaUnitedStates
patent,andMOTOROLAwillpaythosecostsanddamages
nallyawardedagainsttheenduserpurchaserinanysuchsuit
whichareattributabletoanysuchclaim,butsuchdefenseand
paymentsareconditionedonthefollowing:
1.thatMOTOROLAwillbenotiedpromptlyinwritingbysuch
purchaserofanynoticeofsuchclaim,
2.thatMOTOROLAwillhavesolecontrolofthedefense
ofsuchsuitandallnegotiationsforitssettlementor
compromise,and
3.shouldtheProductorpartsbecome,orinMOTOROLA’s
opinionbelikelytobecome,thesubjectofaclaimof
infringementofaUnitedStatespatent,thatsuchpurchaser
willpermitMOTOROLA,atitsoptionandexpense,either
toprocureforsuchpurchasertherighttocontinueusing
