After 90 days and up to one year, PERFORMANCE TOOL® will replace defective parts at no charge, provided a sales receipt showing the date of purchase accompanies the defective product or part. The warranty excludes consumables (blades, bits, fuses, hoses, etc.) and does not cover products used for purposes other than their design, repaired or altered in any way, or subjected to misuse, neglect, accident, or normal wear and tear. PERFORMANCE TOOL® does not authorize any other person to make warranties or assume liability on its behalf. The warranty explicitly disclaims express or implied warranties of merchantability and fitness for a particular purpose, except for goods purchased for personal, family, or household use, where an implied warranty of merchantability (and, if applicable, fitness for a particular purpose) is provided for the particular qualities or characteristics and duration expressly warranted. The company is not liable for consequential, incidental, or special damages. The sole remedy for a defective product or part is repair or replacement.
