Overview

This document provides a comprehensive guide for the Shock Doctor Trash Talker and Trash Talker Basketball Mouthguard, covering its limited warranty, disclaimer, and fitting instructions.

Function Description

The Shock Doctor Trash Talker and Trash Talker Basketball Mouthguard is designed to protect the sound, natural teeth of the user during supervised athletic contests or coach-supervised training sessions. It functions by providing a custom-fit barrier that absorbs impact and distributes forces, thereby preventing dental damage or injury. The mouthguard is intended for use in sports where dental protection is necessary, such as basketball. Its advanced material is designed to soften when heated, allowing for a custom impression of the user's teeth, which then hardens to provide a secure and protective fit.

Important Technical Specifications

  • Warranty Period: One (1) year from the date of purchase.
  • Maximum Liability: Up to $50,000 per incident.
  • Per Tooth Liability: $1563 per injured or replaced tooth.
  • Fitting Temperature: Initial fitting requires water heated to 150°F (65.5°C). Repeat fitting, if necessary, uses water at 140°F (60°C).
  • Material Properties: The advanced material softens to a firm, putty-like consistency when heated, allowing for manipulation and forming to the teeth. It then hardens to maintain the custom impression.
  • Exclusions: The warranty does not cover orthodontic treatments or preparation of a tooth to be used as an anchor for a bridge. It is also explicitly stated as NOT FOR USE WITH BRACES.
  • Temperature Strip: Included for accurate water temperature measurement during fitting.

Usage Features

Fitting Process: The fitting process is detailed and requires careful attention to achieve an optimal custom fit.

  1. Preparation:
    • Gather necessary items: temperature strip (included), large clear glass measuring cup or small saucepan, 8" or larger pot, slotted spoon (optional), and a mirror. A thermometer can also be used.
    • Heat Water: Heat 16 oz of water to 150°F (65.5°C). This can be done on a stove (do not boil, then pour 12 oz into a glass measuring cup) or in a microwave (pour out approximately 4 oz after heating to result in 12 oz).
    • Verify Temperature: Fully immerse the included temperature strip in the water. The strip should indicate 150°F (Green/Gold color, or about 145°F). If the strip shows no color, the water is too hot. If too hot, cool the water by adding small amounts of room temperature water. Crucially, do not immerse the mouthguard in water that is too hot.
  2. Soften Mouthguard:
    • Insert the mouthguard, facing up, into the warm water at the bottom of the container.
    • Wait approximately 35-45 seconds. Gently move the mouthguard with a spoon edge after 30 seconds to prevent sticking to the bottom.
    • Observe the mouthguard's sidewalls and front shape; they should appear relaxed.
    • Carefully remove the mouthguard from the warm water. It will be very pliable. Ensure the soft walls are straight and the arch channel is clear. Do not rush this step.
  3. Placing and Fitting:
    • Alignment: While facing a mirror, carefully center and align the mouthguard on the upper arch of your teeth.
    • Initial Press: Press the inside rim of the mouthguard into the back of the front teeth and the roof of your mouth and sides of your teeth.
    • Custom Impression: Push up on the bottom of the mouthguard along all teeth. Slowly bite down with your front teeth into the front channel to initiate the custom impression. Do not bite hard to avoid biting through the soft material.
    • Clench and Suck: Clench your teeth slowly but firmly on the entire mouthguard. Begin to suck out air and press your tongue against the inside rim of the mouthguard.
    • External Compression: With your fingers, firmly press the outside of the front walls of the mouthguard against your front row of teeth and gums. Close your mouth and suck in air to create a vacuum. Continue to compress the mouthguard against all teeth and gums by pressing on the outside of your lips and cheeks.
    • Hardening: Maintain pressing and compressing the mouthguard against your teeth and gums with a firmer bite until it starts to harden. Keep it in your mouth for at least 4 minutes to allow for continuous custom adjustment as the material hardens.
    • Speeding Hardening (Optional): After two or three minutes, you can drink ice-cold water and swirl it around the mouthguard to speed up the hardening process while maintaining the vacuum effect by sucking in air.
    • Final Check: Remove the mouthguard and immerse it in ice-cold water for three to five minutes. Check the fit.
  4. Repeat Fitting (If Needed): If the fit is not as tight as desired, repeat the warming instructions. Use the Temp strip and immerse the mouthguard in 140°F (60°C) water for 30-35 seconds, then repeat the fitting process.

Maintenance Features

  • Storage: Mouthguards are best stored in a clean mouthguard case when not in use.
  • Cleaning: Clean the mouthguard regularly by washing it under hot water. If using soap, rinse the mouthguard thoroughly before wearing.
  • Temperature Sensitivity: Always protect the mouthguard from heat environments such as hot dashboards and hot car interiors. Store at room temperature.
  • Avoid Chewing/Distorting: Never chew or distort the mouthguard, as this can damage it and reduce its fit and effectiveness.

Warranty and Disclaimer Conditions

To ensure the warranty remains valid, specific conditions must be met:

  • Proper Fitting: The mouthguard must be fitted by the claimant in accordance with the printed instructions provided.
  • Timely Notice of Injury: A complete written notice of injury or damage must be received by Shock Doctor within thirty (30) days after the occurrence.
  • Substantiation of Injury: The notice of injury must be substantiated by:
    • A statement from a licensed dentist detailing necessary dental treatment within thirty (30) days after the injury date.
    • A statement from a participating game official (for supervised contests) or a supervising coach or school superintendent (for practice sessions) confirming the mouthguard was in proper use at the time of injury.
  • Return of Mouthguard: The mouthguard unit must be returned to Shock Doctor with the written notice of injury. Upon receipt, the mouthguard becomes the property of Shock Doctor.
  • Insurance Reduction: Shock Doctor's obligations under the warranty will be reduced by any insurance collected or payable for the damage or injury claimed.

The warranty is made in lieu of all other warranties, express or implied, including but not limited to the implied warranty for a particular purpose and any implied warranty arising out of a course of dealing, custom, usage, or trade. Shock Doctor disclaims all liability for loss, injury, or damage based upon negligent design or defects in materials and workmanship for the mouthguard, except as expressly provided in the warranty.

Users are advised to keep the dental warranty, disclaimer, and store receipt in their records. In case of injury, the mouthguard, store receipt, the notice of injury, and accompanying statements should be mailed to Shock Doctor, Inc. at 11488 Slater Avenue, Fountain Valley, CA 92708.
