1.General
Thiswarrantyisgrantedwithoutprejudiceandinadditiontotherecognizedrightsfortheconsumer
vis-à-visthesellerprovidedintheRoyalLegislativeDecreeof16November,approvingtherestatedtext
oftheGeneralLawfortheProtectionofConsumersandUsersandothercomplementarylegislation.
Therefore,therecognizedlegalrightsfortheconsumerarenotlimitedorexcludedaccordingtothe
relevantRegional,NationalorEuropeanlegislation.
ThiswarrantyshallbevalidinalltheEuropeanUnionMemberStateswiththelimitationsthatlegally
correspondinthecountryinwhichtheyareintendedtobeimplementedinaccordancewiththeir
implementinglegislation.
Notwithstandingtheforegoing,SUNSTECHshallrespecttherightsandlimitationsrelatedtotheproduct
warrantythatlegallycorrespondineachoftheStateslistedintheAttachmentinaccordancewiththeir
implementinglegislationforanyproductprovidedthatitisintendedfortheEUmarketandhasbeen
purchasedorusedbytheconsumeroruserwithintheEEA.
2.LegalWarranty
ThisSUSTECHproducthasatwo(2)yearwarrantycountingfromthedateofdeliveryand/orpurchase.
Duringtheabovetimeframe,SUNSTECHshallbeheldresponsibleforanylackofconformityofthe
productinrelationtothecontractinaccordancewiththeprovisionsoftheLawfortheProtectionof
ConsumersandUsers,thatshallentitletheconsumertorequesttherepairorreplacementoftheproduct,
unlessoneoftheseoptionsisobjectivelyimpossibleordisproportionate.
Accordingly,theremedy(i.e.therepairorreplacement)shallbedeemedtobedisproportionateifit
imposesunreasonablecostsontheseller.Inordertodeterminethis,thefollowingshallbeconsidered:(i)
thevalueoftheproductiftherewerenolackofconformity;(ii)therelevanceofthelackofconformity;
and(iii)iftheotherformofremedycouldbecarriedoutwithoutmajorinconveniencetotheconsumer
anduser.
To determinewhetherthecostsareunreasonable,thecostsincurredbyoneformofremedymustbe
significantlyhigherthanthecostscorrespondingtotheotherformofremedy.
Inaddition,theconsumermaychoosebetweenrequestingareductioninthepriceorterminatingthe
contract,ifheisnotentitledtodemandtherepairorreplacementoftheproductandwheneverthese
actionswouldnotbecompletedwithinareasonabletimeframeandwouldcausemoreinconvenience
totheconsumeranduser.However,theterminationshallnottakeplacewherethelackofconformityis
minor.
Boththerepairandthereplacementoftheproductasresultoftheproduct ’ slackofconformityshallbe
freeofchargefortheconsumeranduser,includinglabourandmaterials.
Inanycase,repairsunderwarrantyshallbecarriedoutbySUNSTECH
’ sOfficialTechnicalAssistance
Serviceoritsauthorizeddistributors.
