3.Conditionsforthewarrantytobeexercised
To
exercisethelegalandcommercialwarranty,itisnecessarytosubmitdocumentaryevidenceshowing
thedeliveryand/orpurchasedateoftheproduct,whethertheinvoice,receipt,deliverysliporsealedand
datedwarrantycard.Documentswhichhavebeentamperedwithorfalsifiedwillnotbeaccepted.
TheconsumershallcontactSUNSTECH
’
sCustomerServiceTeamusingthewebsite(underthesupport
section)andwillbeinformedaboutwhatactiontotake.Atthattime,theconsumershallhavetoprovide
acleardescriptionofthemalfunctionorthelackofconformityoftheproductwiththecontract.
Inanycase,repairsunderthewarrantyshallbecarriedoutbySUNSTECH

ServicesoritsauthorizeddistributorssothatSUNSTECHcanbeheldresponsibleunderthelegaland/or
commercialwarranty.
4.Exceptions
Thewarrantydoesnotforeseeorincludeperiodicmaintenanceorproductinstallationrevisions.
Inaddition,theproductwillnotbeconsideredaslackingconformityinrelationtothecontractand
therefore,itwillnotbecoveredbythelegalorcommercialwarrantywhen:
•Thelackofconformitycorrespondstoadiscrepancywiththesafetystandardsorthelocalornational
techniquesofadifferentcountrytotheoneitwasoriginallydesignedandproducedin;
•Thisproductoranyofitsidentificationfeatures(numberofseries,etc.)havebeenpartiallyor
completelyopened,assembled,unassembled,handledand/orrepairedbyapersonnotpartof

•Thelackofconformityisaresultofanincorrectinstallation(exceptiftheinstallationhasbeen
carriedoutbyoneofSUNSTECH

sauthorizedsellersorunderitsresponsibility,orbytheconsumer
followingSUNSTECH

sinstallationinstructions)oranabusiveorinadequateuseoftheproduct,
includingbutnotlimitedto,ausagethatisnotinaccordancetothenormalpurposeoftheproduct
orthedirectionsforuseandmaintenance,asdefinedbySUNSTECH;
•Thelackofconformityhasbeencausedbyacomputervirus,anactionoramanipulationof
passwords,softwareinstallation,manipulationorreinstallation,etc.;
•Thelackofconformityisduetotheuseofaccessories,chargersorconsumablesthatarenot
SUNSTECHoriginalsandthereforearenotdesignedforthatproduct;
•Thelackofconformityisduetotheuseofanythirdpartysoftwareorapplicationthatmodifies,
changesoradaptsthesoftwarethatwasapprovedand/orincludedbySUNSTECHintheproduct;
•Thelackofconformityisaresultofdownloadingorusingthirdpartymultimediaservicesand/or
contentsavailableoraccessiblethroughtheproduct;
•Damagesinorthroughthebattery,whichareduetoitbeingovercharged,areproduced;
•Anyoftheboxsealsorbatterycellshavebeendamaged,orthereisclearevidencethatshowsthese
werehandled;and/or
•Theproductdamagesarecausedbyanyunforeseeableorforcemajeurcircumstances,especially,
lightning,water,fire,applyingincorrectvoltageoranyothercausethatisnotduetotheproduct
manufacturingordesign.
UndernocircumstanceswillSUNSTECHbeheldresponsibleforthelossofanydatastoredintheproduct.The
consumerwillbeheldresponsibleforanyback-upcopiesandtheprotectionofanydatafromloss,damageor
destruction.
