Exclusion of all other liability
• Imation's liability in contract, tort including negligence or otherwise for any breach or any loss,
damage or expense suffered or incurred by any purchaser of the Product or the Software, whether
direct or indirect INCLUDING, WITHOUT LIMITATION, THE LOSS OF BUSINESS REVENUE, PROFITS,
SAVINGS, DATA, OR ANY CONSEQUENTIAL LOSS, is excluded to the fullest extent permitted by law.
Subject to the paragraph below, all conditions and warranties on the part of Imation implied by law
in relation to the Product or the Software are excluded to the maximum extent permitted by law. For
customers in the United States, this means that any implied warranties regarding the Product are
limited to a period of 12 months from the date of purchase and any implied warranties regarding the
Software are limited to a period of 90 days from the date of purchase.
• To the extent that Imation may be liable for a breach of a condition or warranty implied by law, the
liability of Imation will at its option (and to the extent permitted by law) be limited to the replacement
or repair of the Product or the supply of an equivalent product or payment or cost of replacement,
repair, or resupply.
• Opdicom Pty. Ltd. Is the manufacturer of the Product and, to the extent applicable, will have the
benefit of the above limitations on the warranty and exclusion of liability.
Notice for customers in the United States of America
This warranty gives specific legal rights, and you may also have other rights which vary from state to state. Some
states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or
exclusion may not apply to you. Some states do not allow limitations on how long an implied warranty lasts, so the
above limitation may not apply to you.
