WARRANTY LIMITATIONS AND EXCLUSIONS

limitedto,theimpliedwarrantiesofmerchantability,non-infringrent,andtnessfora
particularpurpose.JMPosnermakesnoexpresswarranties,beyondthosestatedhere.
JMPosnerdisclaimsallotherwarranties,expressedorimplied,includingwithoutlimitation
impliedwarrantiesofmerchantability,non-infringement,andtnessforaparticular
purpose.TheJMPosnerlimitedwarrantyandanyimpliedwarrantiesthatmayapply,
extendonlytotheoriginalpurchaseofthespecicJMPosnerproducts,asidentiedby
serialnumberandremaininforceonlyaslongassuchpurchaserownsthefountain.
Somecountriesdonotallowtheexclusionofimpliedwarrantiessothislimitationmay
notapplytoyou.Iftheselawsapply,thenallexpressandimpliedwarrantiesarelimited
indurationtothelimitedwarrantyperiod,nowarrantiesapplyafterthatperiod.Some
countriesdonotallowlimitationsonthedurationofanimpliedwarranty,sothislimitation
maynotapplytoyou.
LIMITATION OF LIABILITY

providingofreplacementcomponentsforrepairoftheproductpurchased,assetforth
above.Theseremediesarethesoleandexclusiveremediesforanybreachofwarranty.
You,thepurchaser,agreeandacknowledgethatJMPosnerhasnoliabilityandshall
notberesponsibleforanydamageyoumayincurfromnonreceiptofthefountainorits
construction,oranyothercause,whetherliabilityisassertedincontract,tort,orotherwise.
JMPosnerisnotresponsibleforindirect,special,incidental,orconsequentialdamagesof
anykindresultingfromanybreachofwarrantyorunderanyotherlegaltheoryincluding,
butnotlimitedto,lostprots,downtime,goodwill,ordamagetoorreplacementof
equipmentandproperty.
