TYMCO REGENERATIVE AIR SWEEPERS are warranted to be
free from defective materials and workmanship for a period of 12
months or 1,000 hours from date of delivery and such period being
hereinafter referred to as “warranty period”. It is the sole obligation
of Seller with respect to this warranty period to replace free of
charge, F.O.B. Waco, Texas, any part or parts which may prove to
be defective due to defective workmanship or materials within the
warranty period provided no disarrangement of using unautho-
rized parts or changes to the machinery be made voluntarily or by
incompetency, carelessness, negligence, accident,or need of at-
tention upon the part of purchaser, agents, employees or other
parties.
This warranty shall not cover normal maintenance and adjust

ments, and the same not include nor shall Seller be liable or re
-
sponsible for material for normal wear and usage for any damages
by reason of loss of production, down time or loss of profits or in
-
come arising from any reason whatsoever. Seller reserves the
right to change the design and construction of said sweeper when
in its sole opinion any such change represents an improvement of
the sweeper. All outside purchased equipment and accessories
are guaranteed only to the extent that the manufacturer’s guaran
-
tee may apply and are not subject to this warranty nor to any
implied warranty.
This warranty is in lieu of all other warranties, expressed or im
-
plied. No person is authorized to give any other warranties or to
assume any other liability on the Company’s behalf unless made
in writing by the Company, and no person is authorized to give any
warranties or to assume any liabilities on the Seller’s behalf unless
made in writing by the Seller.
