WARRANTY
Evoqua Water Technologies warrants each new CAPAC
®
SYSTEM or part
thereof manufactured by it, to be free from defects in workmanship or material, under
normal use of service, for a period of one (1) year from the date of installation of such
system or eighteen (18) months from date of shipment, which ever occurs first.
Our obligation under this warranty is limited to, at our option, the repair or
replacement, f.o.b. our Union, New Jersey plant, of such systems of parts thereof
which are found, after inspection by us, to be defective. We assume no liability for
damages of any other kind whatsoever, and in no event shall we be liable for
incidental and/or consequential damages.
THIS WARRANTY IS EXCLUSIVE AND IS IN LIEU OF ANY AND ALL OTHER
WARRANTIES, ARISING BY LAW OR CUSTOM, EXPRESSED OR IMPLIED,
INCLUDING, BUT NOT BY WAY OF LIMITATION, THE IMPLIED WARRANTY OF
MERCHANTABILITY AND THE IMPLIED WARRANTY OF FITNESS FOR PARTICULAR
PURPOSE.
