WARRANTY
The seller warrants that the instrument or accessories delivered on this order have been
thoroughly inspected, tested, and calibrated and found to meet their published
specifications when shipped from the factory. Seller further warrants that the
instrument or accessory will be free from defects in materials or workmanship for a
period of one year from date of shipment from factory.
The factory warranties are in lieu of all other warranties by the seller, express or
implied, and are the sole and exclusive warranties of the seller.
In the event of a breach of warranty, the Seller’s only obligation shall be, at the Seller’s
sole option:
1. To repair the instrument
2. To replace it with an equivalent instrument, or
3. To make a credit adjustment not to exceed the original sale price
Provided, however, that the following conditions have been met:
a) Seller is promptly notified in writing by buyer upon discovery of
defects,
b) The defective equipment is returned to the seller, transportation
charges prepaid by buyer, and
c) Seller’s examination of such equipment discloses to seller’s
satisfaction that defects were not caused by negligence, misuse,
improper installation, accident, or unauthorized modification or
repair.
Under no circumstances shall IRCON have any liability for liquidated damages or for
collateral, consequential or special damages, or loss of profits, whether resulting from
delays in delivery of performance, breach of warranty, claims of or negligent
manufacture or otherwise. The aggregate total liability of IRCON under this contract,
whether for breach of warranty or otherwise, shall in no event exceed the purchase
price.
All warranties hereunder extend only to the original buyer.
Material contained herein consists of information that is the property of Ircon, Inc. and
intended solely for use by the purchaser of the equipment described in this manual.
Ircon, Inc. prohibits the duplication of any portion of this manual or the use thereof for
any purpose other than the operation or maintenance of the equipment described
herein without the express written permission of Ircon, Inc. All specifications are
subject to change without notice.
