IN NO EVENT SHALL ORGANIC TRANSIT BE HELD RESPONSIBLE FOR DIRECT,
INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES FOR PERSONAL
INJURY, PROPERTY DAMAGE OR ECONOMIC LOSSES, WHETHER BASED ON
CONTRACT, WARRANTY NEGLIGENCE, PRODUCT LIABILITY OR ANY OTHER
THEORY.
Some states do not allow the exclusion or limitation of damages, so the above limitation
may not apply.
The ELF is a LOW-speed electric bicycle under U.S. Code Title 15, Chapter
47 Section 2085 and as such is eligible to travel on all U.S. roads open to
bicycle travel.
“…The termlow-speed electric bicycle means a two or three-wheeled electric
vehicle with fully operable pedals and an electric motor of less than 750 watts (1
h.p.), whose maximum speed on a paved level surface, when powered solely by
such a motor while ridden by an operator who weighs 170 pounds, is less than
20mph.
This section shall supersede any State law or requirement with respect to low-
speed electric bicycles to the extent that such State law or requirement is more
stringent than the Federal law or requirements referred to subsection (a) of this
section.
