whenthereisreasonforurgency,thecus-
tomer demands immediate replacement
of the product he has claimed warranty
for, before the decision as to the claim
has been made, said request shall be
accompanied by a Purchase requision
from the Commercial Department. Aer
a decision for sasfacon of the claim
hasbeenmade,thePurchaserequision
menonedabovewillbeannulledbyissu-
ingareceiptforreturnedgoods;withthis
receiptthecustomercanpurchaseanoth-
erproductwiththesamepriceincasethe
claimhasprovedgrounded.
e) NES Ltd. preserves the right to
makeinsitureportsfromtheclaimsthey
havereceived,forthepurposeofchecking
everyaspectthatmightbeusefulforbet-
terconsideraon of warrantyclaims; for
thisreasonthe customershall notmake
any changes in installaon condions
which are reasons for the claim without
priorwrienconsentoftheTechnicalDe-
partment.
10.4.Limitaonofliability
a) NESLtd.isnotliablebeforethe
customer, neither directly nor indirectly,
foranynon-fulllmentordelayatapply-
ingthewarrantyobligaonswhichmight
originatefromexternalpressureofother
circumstancesoutsideNESLtd.
b) The liability of NES Ltd. under
thisWarrantyCercateislimitedtothe
abovemenoned obligaons and up to
thesuminaccordancewiththepurchase
receiptoftheproducttobeclaimed;ex-
cludedisanyliabilityforindirectdamages
suchaslossofdataatinformaonappli-
caons, loss of producon thermal var-
iaons at the service, etc. which do not
violate the applicable regulaons of any
countryconcerningproductliability.
c) Abovemenoned warranty limi-
taonswill be applied in any cases, and
whentheydonotviolatetheregulaons
inanycountryconcerningproductliabil-
ity. If this circumstance annuls some of
preceding clauses, annulment will refer
only tothis clause, while the others will
remain valid.  In conclusion, excluded is
applicaonofanyRegulaonpointedout
in this Warranty which violates the Law
23/July10, 2003 and Direcve 1999/44/
EU concerning water heaters and their
useontheterritoryoftheEU.
Anyotherwarrantyrightthatisnotmen-
oned in this Warranty Cercate is ex-
cluded
