EXEMPLARY DAMAGES ARISING OUT OF
OR IN ANY WAY RELATING TO THE
CUSTOMER'S USE OF THE PRODUCT,
APPLICATION, SOFTWARE OR DATA IN
THE PRODUCT. TRIUMPH MOTORCYCLES
LIMITED ONLY SUPPLIES THE PRODUCT
FOR DOMESTIC AND PRIVATE USE, THE
CUSTOMER AGREES NOT TO USE THE
PRODUCT FOR ANY COMMERCIAL,
BUSINESS OR RESALE PURPOSE, AND
TRIUMPH MOTORCYCLES LIMITED HAS
NO LIABILITY TO THE CUSTOMER FOR
ANY LOSS OF PROFIT, LOSS OF
BUSINESS, BUSINESS INTERRUPTION, OR
LOSS OF BUSINESS OPPORTUNITY.
2.2
NOTHING IN THESE TERMS SHALL LIMIT
OR EXCLUDE TRIUMPH MOTORCYCLES
LIMITED LIABILITY FOR (A) DEATH OR
INJURY CAUSED BY ITS NEGLIGENCE; (B)
FRAUD OR FRAUDULENT
MISREPRESENTATION; OR (C) DAMAGES
CAUSED WILFULLY OR WITH GROSS
NEGLIGENCE.
3. Third-Party Applications
The product may display or make
available content, data, information,
services, software or materials from
third-party applications which run on
the customers device, equipment and
smartphone. Triumph Motorcycles
Limited has no control over and is not
responsible for examining or evaluating
security, content, accuracy, validity,
legality, or any other aspect of such
third-party applications. Triumph
Motorcycles Limited assumes no
responsibility or liability for the
availability, content, security, privacy
policies practices or performances of
any such third-party application.
To the maximum extent permitted by
applicable law, Triumph Motorcycles
Limited does not warrant, guarantee or
endorse any third-party applications
and is not liable to the customer or any
other party for its misuse or any third-
party application. The customer
expressly acknowledges and agrees
that the use of third-party applications
is subject to the third-party's terms and
conditions and policies, including its
privacy policy, and such terms and
conditions and policies are agreed
between the customer and the third-
party. The customer is consequently
advised to check third-party
applications terms and conditions and
privacy policies prior to accepting them.
Triumph Motorcycles Limited is not
responsible for any third-party
applications and any terms and
conditions relating to the third-party
applications. Triumph Motorcycles
Limited may change, reduce, limit,
suspend, remove, modify access to or
disable access to any third-party
application at any time and without
notice to the customer.
