EmissionsControlCompliance:TheFederalCleanAirAct,Section203(a)(3),statesthe
followingconcerningtheremovalofairpollutioncontroldevicesormodicationofa
certiedenginetoanon-certiedconguration:
“Thefollowingactsandthecausingthereofareprohibited:
(3)Foranypersontoremoveorrenderinoperativeanydeviceorelementofdesigninstalled
onorinamotorvehicleormotorvehicleengineincompliancewithregulationsunderthis
partpriortoitssaleanddeliverytotheultimatepurchaser,orforanymanufactureror
dealerknowinglytoremoveorrenderinoperativeanysuchdesignaftersaleanddeliveryto
theultimatepurchaser.”
Specically,pleasenotethatnopersonmaymakesuchchangespriortothesaleanddelivery
ofthevehicletotheultimatepurchaser,and,inaddition,nomanufacturerordealermay
maketakesuchactionaftersaleanddeliveryofthevehicletotheultimatepurchaser.The
lawprovidesapenaltyofupto$10,000foreachviolation.
Modications,suchasreprogrammingofthefuelsystemsotheenginewillexceedthe
certiedhorsepowerortorque,orremovingthemufersareexamplesofillegalchanges.
Changesshouldnotbemadetoacertiedenginethatwouldresultinanenginethatdoes
notmatchthecongurationofanenginemodelthatiscurrentlycertiedtomeetFederal
Standards.
Mexico
ThesameconditionsthatapplyintheUSAapplytoMexico.RefertotheMexicanFederal
LawforEmissionControlwhichadherestoEPAregulations.Nochangesshouldbemade
thatrenderanyoralloftheemissionscontroldevicesinoperative.
Iftheowner/operatorwishestomakechangestotheemissioncontroldevices,checkwith
thestateauthoritybeforechangesaremade.
Canada
ThesameconditionsthatapplyintheUSAapplytoCanada,withoneexception.Afterthe
vehicleissoldtoaretailcustomer,thatis,theenduser,thejurisdictioncontrollingthe
emissioncontroldevicesbecomestheprovinceinwhichthevehicleislicensed.Nochanges
shouldbemadethatrenderanyorallofthedevicesinoperative.
Shouldtheowner/operatorwishtomakeanychangestotheemissioncontroldevices,check
withtheprovincialauthoritybeforemakinganysuchchanges.
