SC OPE OF THE LIMITED WARR ANTY
Bomba rdier Recr ea tional Products Inc. ("BRP") * warra nts its 2016 C a n-Am ATV
sold by authorized Ca n- Am ATV dealers (as hereinafter defined) in the Uni ted
States of A m erica ("USA" ) and in Canada from defects in material or workmanship
for the p eriod a nd under the c onditions des cr ibed bel ow. This lim ited warranty w il l
become nu ll and void if: (1) the ATV was used for rac ing or any other compe titive
activity, at any po int, even by a previous owner; o r (2) the ATV has been altered
or m odified in such a way so as to adv ersely affect its operation, performa nce or
durability, o r has been altered or modified to change its intended use.
Except if otherwise specified, all genuine Can-Am ATV parts and accessories in-
stalled by an authori zed BRP deale r on a 2016 Can-Am ATV at the time of delivery
are cov ered under this l imited warranty. Without limiting the generality of the
foregoing, the A pache
TM
and Apache 360
TM
are not covered under this limited
warranty.
LIMITATIONS OF LIABIL ITY
THIS WARRANTY IS EXPRESSLY GIVEN AND ACCEPTED IN LIEU OF ANY
AND ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING
WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY OR FIT-
NESS FOR A PARTICULAR PURPOSE TO THE EXTENT THAT THEY CANNOT
BE DISCLAIMED, THE IMPLIED WARRANTIES ARE LIMITED IN DURATION
TO THE LIFE OF THE EXPRESS WARRANTY. INCIDENTAL AND CONSE-
QUENTIAL DAMAGES ARE EXCLUDED FROM COVERAGE UNDER THIS
WARRANTY SOME STATES/PROVINCES DO NOT ALLOW FOR THE DIS-
CLAIMERS, LIMITATIONS AND EXCLUSIONS IDENTIFIED ABOVE, AS A
RESULT, THEY MAY NOT APPLY TO YOU. THIS WARRANTY GIVES YOU
SPECIFIC RIGHTS, AND YOU MAY ALSO HAVE OTHER LEGAL RIGHTS
WHICH MAY VARY FROM STATE TO STATE, OR PROVINCE TO PROVINCE.
Neither the distributor, any BR P dealer nor any other person ha s been a uthoriz ed
to ma ke any affirmation, representat ion or warranty rega rding the product, other
than th os e contained in this l imited warranty, and if made, sha ll not be en forceabl e
against BRP. B RP reserves the right to modify this w arranty at an y time , being un-
derstood tha t such m odification w ill n ot alter the warranty conditions a ppli cable to
the products sold while this warranty is in effect.
EXCLUSIONS – ARE NOT WARRANTED
The following are not wa rranted under a ny circumstances:
– Normal w ea r and tear;
– Routine maintenance items, tune ups, adjus tm ents ;
– Dama ge caus ed by fail ure to provide proper maintenance and/or storage, as de-
scribed in the Opera tor' s Gu ide;
– Dama ge resulting from removal of parts , improper repa irs, service, ma inte-
nance, modifica t ions or us e of pa rts not m anufa c t ured or approved by BRP
or res ulting from rep airs done by a pers on that is not an authorized servici ng
Can -Am ATV dealer;
