10. Guarantee
Müthing mulchers are manufactured with great care, using modern production methods and are
subject to numerous checks.
Consequently Müthing issues a guarantee as part of its General Terms and Conditions in line
with the following statement (extract from General Terms and Conditions):
1. The rights of the customer with regard to product defects are laid down by law. If the
customer is not a consumer (Article 13 German Civil Code) these rights are restricted by
the provisions of clauses 2 – 8 below.
2. Discrepancies or changes lying within the bounds of relevant technical standards shall not
constitute a defect. The same applies to standard commercial, and technically unavoidable
discrepancies where they do not impair the utility of the goods for use in accordance with
the contract.
3. If a particular quality of the item is agreed a departure from this only constitutes a
negligible defect if the suitability of the item for the contractually agreed use is not impaired
or only to a negligible extent. In this case compensation claims or withdrawal from the
contract as a result of the defect are ruled out.
4. The right of the customer to subsequent performance is restricted to a repair of the item if
this is reasonable for the customer, especially if this can remedy the defect in a similar
fashion to resupplying the item.
5. The customer can only claim that subsequent performance has failed if at least two
attempts at subsequent performance have been unsuccessful and at least 3 weeks have
elapsed since the complaint.
6. The period of grace set by the customer shall be deemed unreasonable if it is less than
three weeks counting from the date on which we were notified of the period of grace.
Periods of grace must be set in writing.
