In all other respects, claims asserted by the customer for damages
and/or the reimbursement of expenses, regardless of the legal
grounds – in particular due to a breach of duties arising from
the contractual obligations or unlawful acts – are excluded. This
does not apply to product liability claims or in cases of intent
and gross negligence or involving loss of life or bodily injury, or
if the claims are based on the breach of an obligation whose
fulfillment makes the proper execution of the contract possible
in the first place and on whose fulfillment the customer may
regularly rely. However, any claims for damages due to the
violation of essential contractual obligations shall be limited to
the kind of foreseeable damages that are typical for the contract,
except in cases of gross negligence or if liability is assumed for
loss of life and/or bodily injury.
