1. Generaltermsoflimitedwarranty:
Thislimitedwarrantygivesyouspecificlegalrights,andyoumayalsohaveotherrightswhichvaryfromState
toState.Themanufacturer,Hydro‐SmartInc.willhonorthewarrantytotheoriginalretailbuyeratthe
originallocationonly,anditisnottransferable.THISWARRANTYCOVERSONLYFAILED

ELECTRICALPARTSDUETOFACTORYDEFECTSUNDERNORMALUSAGEFORTHEPRODUCT’SINTENDED
PURPOSES.ONLYDIRECTDAMAGESSHALLBERECOVERABLEBYACLAIMANTUNDERTHISLIMITED
WARRANTYAND,INNOEVENT,WHETHERASARESULTOFBREACHOFCONTRACT,BREACHOFWARRANTY,
TORTLIABILITY(INCLUDINGNEGLIGENCE),STRICTLIABILITY,
INDEMNITYOROTHERWISEWILLHydro‐Smart
BELIABLEFORANYSPECIAL,INCIDENTAL,ORINDIRECTCONSEQUENTIALDAMAGESINCLUDINGPROPERTY
DAMAGE,PERSONALDAMAGES,LOSSOFUSE,ORINCONVENIENCE.SOMESTATESDONOTALLOWTHE
EXCLUSIONORLIMITATIONOFINCIDENTALORCONSEQUENTIALDAMAGES,SOTHEABOVELIMITATION
MAYNOTAPPLYTOYOU.
2. Parts
Warranty
Ifallofmechanicaland/orelectricalpartfailswithintwo(2)yearsinnormaloperationwith“IntegratorPanel”
andproperinstallation(seeinstructionfrominstallationmanual)fromthepurchasingdate,Hydro‐SmartInc.
willfurnishareplacementpart(s)excludingfieldlaborandshipping.
3. Repair,ReplacementorRefund
:
Themanufacturer,Hydro‐SmartInc.oritsauthorizedServiceRepresentativewill,atitssolediscretion,repair
orreplaceanyfailedordefectivemechanicalorelectricalparts,orcomponentsthereof,or,ifHydro‐Smartor
its authorized Service Representative cannot replace said parts, and repair is not commercially practicable,
Hydro‐Smart
or its authorized Service Representative will refund the purchase price.Hydro‐Smart or its
authorizedServiceRepresentativemay,atitssolediscretion,usenew,refurbishedorreconditionedparts.
4. LimitationonDurationofImpliedWarranties:
ANYIMPLIEDWARRANTIESARISINGUNDERSTATELAW,INCLUDINGTHEIMPLIEDWARRANTIESOFFITNESS
FORAPARTICULARPURPOSEANDMERCHANTABILITY,SHALLINNOEVENTEXTENDPASTTHEEXPIRATION
OFANYWARRANTYPERIODHEREUNDER.SOMESTATESDONOALLOWLIMITATIONSONHOWLONGAN
IMPLIEDWARRANTYLASTS,SOTHEABOVELIMITATIONMAY
NOTAPPLYTOYOU.
5. THISWARRANTYWILLNOTCOVERTHEFOLLOWING:
AnyHydro‐Smartunitthatisnotinstalledbyalicensedplumber,gasinstaller,orcontractor.
Damagesduetoaccidents,abuse,misuse,improperinstallation,misapplication,orincorrectsizing.
Damagesduetofires,flooding,freezing,electricalsurges,oranyActsofGod.
Damagesduetounauthorizedalterations,
attachments,and/orrepairs.
Damagesduetoalackofmaintenance.(e.g.watertreatmentsystem,ventblockage,etc.)
Any Hydro‐Smart unit installed in an improper environment (e.g. corrosive, dusty, chemically
contaminated,excessivelint,etc.).
Freeze damage that occurs withouttaking proper preventive measures as described in the installation
manual.
Condensatedamageduetoimproperlyinstalledorlackofacondensatetrap(drain).
AnyHydro‐Smartunitnotinstalledincompliancewithallapplicablelocal&statecodes,ordinances,and
goodtradepractices.
Any Hydro‐Smart unit sold to or installed in areas outside of the
fifty states (and the District of
Columbia)oftheUnitedStatesofAmericaandCanada.
Any Hydro‐Smart unit installed in applications that cause the water heater to activate more than 300
timesperday(thisaveragestoanactivationevery5minutesina24‐hourperiod).
Any
failuresthatarenotduetodefectsinmaterialsorworkmanship(mechanicaland/orelectricalparts).
Damagesduetoimproperinstallation:
Gas:incorrectgaspipesizing,incorrectgasmetersizing,incorrectgastype,and/orgaspressures
thatfalloutsidetheproduct’sspecifiedrange.
Water:incorrectwaterpipesizing,waterpressuresthatfalloutsidetheproduct’sspecifiedrange,
recirculationflowratesthatfalloutsidetheproduct’sspecifiedrange(airremoval),and/orlackof
propermethodsofairremovalinaclosed‐loop,circulationsystem(seeinstallationmanualfor
details).
Electric:supplypowervoltagesthatfalloutsidetheproduct’sspecifiedrange.
