17 - DIRECTIONS FOR DISPOSAL
The product must not be disposed of with household waste.
Dispose of in compliance with the national regulations in force.
18 - WARRANTY AND AFTER SALE SERVICE
CONDITIONS
GEL, located in via Enzo Ferrari, 1 Castelfidardo (AN) – Italy, warrant that
the products and equipment, at the time of delivery to the consumer, shall
be free from defects in workmanship and materials. The absence of such
defects guarantees to the consumer that the goods:
comply with the description given in the documentation (technical
specifications, catalogues, price lists, advertising);
are free from defects in design, materials and workmanship;
are fit for the declared purpose under normal operating conditions
and in compliance with the directions given in the instruction manuals
supplied with the equipment.
GEL are liable to the consumer for any defect in workmanship and
materials which appears within 24 months from the date of purchase,
even when warranty operations have been carried out.
In accordance with the directive 99/44/EC valid in the EEC countries, the
warranty rights apply only to the consumer. The warranty supplied by GEL
leaves these rights unprejudiced.
The warranty covers all components of the equipment and provides
for the repair or, if necessary, the free replacement of those parts that,
according to Technical Assistance, show defects in workmanship or
materials.
The warranty does not cover aesthetic parts, wear and tear parts, all
damages or failures whose cause is not due to the manufacturer,
such as: transport, incorrect installation or maintenance, tampering,
sudden changes in electrical voltage and/or hydraulic pressure, lightning,
corrosions, excess of humidity, accidental bumps or events beyond our
control.
The defect is recognised even in case of incorrect installation, if the
installation has been carried out by GEL, i.e. on their own responsibility.
Warranty is also recognised when the equipment, intended to be installed
directly by the consumer, results to be installed improperly due to
incorrect installation instructions.
The warranty is valid only if the equipment has been installed, used
and properly maintained according to all directions given by GEL in the
instruction manual attached to the equipment.
Should any defects in workmanship or materials be found during the
warranty period, the customer shall notify the dealer to agree upon the
terms for repairing and/or replacing the product.
The after sale assistance service under warranty is directly supplied by
GEL in cooperation with the dealers.
Compensation requests for damages to persons, objects or property
which may be due to a defective product must be addressed to GEL
directly, specifying the damage that has occurred, the date when it has
occurred, the defect encountered in the product, the date of purchase.
In accordance with the European Directives 85/374/EC and 99/34/
EC, the burden of proof rests with the claimant. GEL will take such
compensation requests into account only if supported by appropriate
technical assessments. The injured person shall be required to prove:
- the existence of the damage;
- the defect of the product;
- the causal relationship between defect and damage.
GEL shall not be liable for the damage if they prove:
- that they did not put the product into circulation;
- that the product was neither manufactured or distributed by them in the
course of their business;
- that the state of technical knowledge at the time when they put the
product into circulation was not such as to enable the existence of the
defect to be discovered;
- that the defect which caused the damage did not exist at the time when
the product was put into circulation;
- that the product was neither manufactured by them for sale or any form
of distribution for economic purpose;
- that the defect is due to compliance of the product with mandatory
regulations issued by the public authorities.
