EMISSIONWARRANTYFORCARBCERTIFIEDEQUIPMENT
EMiSSiON CONTROL SYSTEM WARRANTY
EmissionControlSystem Warranty (ECSWarranty)for equipmentusing small spark-ignitedengines:
(a) Applicability: This warranty shall applyto equipmentthat uses small off-road engines.The ECSWarranty period shallbegin onthe datethe new
equipmentis purchasedby/deliveredto its original,end-usepurchaser/owner andshall continuefor the lesser of:
(1) The periodof time specified inthe GeneracLimitedWarrantyenclosedherewith, but not lessthan 24 months, or
(2) Forenginesequippedwith hour meters,a number of operatinghours equalto half ofthe engine's useful life. The useful life is specifiedon the
Emissions ControlLabel onthe engine.
(b) GeneralEmissionsWarrantyCoverage:Generacwarrants to the original,end-usepurchaser/owner ofthe new engineor equipmentandto each
subsequentpurchaser/ownerthat the ECSwhen installedwas:
(1) Designed,built and equippedso as to conform with allapplicableregulations;and
(2) Freefrom defectsin materials and workmanshipwhich cause thefailure of a warrantedpart at anytime during the ECSWarranty Period.
(c) The warranty on emissions-relatedparts will be interpretedasfollows:
(1) Any warranted part that is not scheduledfor replacementas required maintenancein the Owner'sManualshall be warrantedfor the ECS
Warranty Period.If anysuch part fails duringthe ECSWarrantyPeriod,it shall be repairedor replacedby Generacaccording to Subsection (4)
below. Anysuch part repairedor replacedunderthe ECSWarranty shall bewarranted for the remainderof the ECSWarranty Period.
(2) Any warranted part that is scheduled only for regularinspection as specified in the Owner'sManual shallbewarranted for the ECSWarranty
Period.A statementin the Owner's Manualto the effect of "repair or replaceas necessary"shall not reducethe ECSWarranty Period.Any
such part repairedor replacedunderthe ECSWarrantyshall bewarranted for the remainderof the ECSWarranty Period.
(3) Any warranted part that is scheduledfor replacementas requiredmaintenancein the Owner'sManualshall be warrantedfor the period of time
prior to first scheduledreplacementpointfor that part. If the part fails priorto the first scheduledreplacement,the part shall be repairedor
replacedby Generacaccording to Subsection (4) below.Any such emissions-relatedpart repairedor replacedunderthe ECSwarrantyshall be
warranted for the remainderof the period prior to the first scheduledreplacementpoint for that part.
(4) Repairor replacementof anywarranted,emissions-relatedpart under this ECSWarrantyshall be performed at no chargeto the ownerat a
GeneracAuthorizedWarrantyService Facility.
(5) Notwithstandingthe provisions of subsection (4) above,warranty services or repairs must be providedat GeneracAuthorizedService
Facilities.
(6) Whenthe engineis inspectedby a GeneracAuthorizedWarranty ServiceFacility,the purchaser/ownershall not beheld responsiblefor
diagnostic costs if the repairis deemedwarrantable.
(7) Throughoutthe ECSWarrantyPeriod,Generacshall maintain a supply of warrantedemission-relatedparts sufficientto meetthe expected
demandfor such parts.
(8) Any Generacauthorizedand approvedemission-relatedreplacementparts may be used in the performance of any ECSWarranty maintenance
or repairs andwill be providedwithout chargeto the purchaser/owner.Such useshall not reduceGeneracECSWarrantyobligations.
(9) Nomodifications, otherthan those explicitly approvedby Generac,may be madeto the generator.Unapprovedmodificationsvoid this ECS
Warranty and shall be sufficientgroundfor disallowing an ECSWarrantyclaim.
(10) Generacshall not be heldliable hereunderfor failures of any non-authorizedreplacementparts, or failures of any authorizedparts causedby
the use of non-authorizedreplacementparts.
