Warranty
7. warranty
When the acquired article presents a lack of conformity because it does not
correspond to the characteristics oered, it presents defects that prevent its
normal use according to its nature, or does not oer the features described
by ONEAN BOARDS (hereinafterONEAN) for the mentioned article, the buyer
will be entitled to the sanitation of the product acquired within two years
from the purchase. Said sanitation will be carried out under the conditions
and with the means of proof regulated in the General Law for the Defense
of Consumers and Users (RDL 1/2007, of November 16), without prejudice
to the powers of ONEAN to verify the veracity of the defects, their origin,
and the moment of their appearance. To make use of this right it will be
necessary for the buyer to present the invoice or purchase ticket.
During the first 6 months of purchase, if the product has a defect that
impedes its proper functioning, it will be understood that this is a factory
defect unless the technical team of ONEAN proves otherwise. However, if
the defect or dissatisfaction is communicated to ONEAN after 6 months
from the purchase, the consumer must prove that the failure or lack of
conformity already existed when the goods were purchased. For this
purpose, the buyer may resort to technical reports or other sufficient
evidence. In any case, the buyer must contact ONEAN within two months of
the nding of the defect, stating the nature of the problem, and the timing
and circumstances of its occurrence.
The buyer will have the right to the sanitation of the property following the
rules of art. 116 et seq. of the General Law for the Defense of Consumers
and Users, for the repair or replacement of the goods (unless one of the
options is impossible or disproportionate), or the reduction or termination
of the contract, if applicable. Any form of sanitation (repair or replacement)
which imposes on the seller costs which, in comparison with the other form
of sanitation, are unreasonable in view of the value of the property shall
be considered disproportionate. The relevance of the lack of conformity of
the product and the fact that the other option could be carried out without
major inconveniences to the buyer will also be taken into account.
The repair that is in guarantee according to the General Law for the Defense
of Consumers and Users will be free of charge, including shipping costs,
labor costs, and repair materials. The customer, after notifying ONEAN
of possible defects in the product purchased, must send the product to
ONEAN stores for the verication of damages or defects by the company’s
technical team. The shipment of the product will be made by a transport
company at the customer’s discretion, although ONEAN, at the moment of
receiving the claim, will provide a quote for the shipment according to the
rates of the transport company with which the company works.
Upon receipt of the item, ONEAN will issue a receipt stating the buyer’s
identication, its address, the defects invoked, and the estimated period of
repair. The notications to the buyer related to the article that are addressed
to the address collected in the receipt of the deposit will be validly made.
The guarantee of the repair carried out will have a duration of 6 months
from the delivery of the product, in accordance with the provisions of the
General Law for the Defense of Consumers and Users. The warranty period
will be interrupted once the product has been delivered for repair, and it
will resume when the item is returned to the buyer.
Once the goods are received in ONEAN’s warehouses, the technical team
will check if all the conditions exist to proceed with the repair of the item
under the coverage of the legal warranty described in the General Law for
the Defense of Consumers and Users. If so, ONEAN will proceed to either
repair the product in the shortest possible time or, if necessary, to send a
new product when the repair is impossible or disproportionate. In addition,
the customer will be reimbursed at the same time the costs incurred for the
transportation of the product to the stores of ONEAN for its assessment
by the technical service, also assuming the company expenses incurred in
sending the product to the customer. In case the client has not accepted
the quotation provided by ONEAN to send the product to its warehouses,
choosing another more expensive option instead, it will be the customer
who will assume the dierence between both quotation, since ONEAN will
only reimburse at most the amount included in the quotation provided the
customer at the time.
If, on the other hand, the defects invoked by the purchaser are found to be
nonoriginating, or for any other reason, they are not subject to the warranty
of the General Law for the Defense of Consumers and Users, ONEAN may
budget for repair outside the warranty. In these cases, if the buyer does
not accept the repair budget, the budget expenses (the time spent by the
