USED TRUCK STATEMENT:
Buyer hereby acknowledges that Schuler Manufacturing and Equipment Co., Inc. (I) is not the manufacturer of
the truck being sold by Schuler Manufacturing and Equipment Co., Inc. and purchased by buyer (The “truck”)
and (II) that Schuler Manufacturing and Equipment Co., Inc. purchased the truck in used condition from a third
party. The purchaser agrees that the truck is being sold by Schuler Manufacturing and Equipment Co., Inc.
and is being purchased by the purchaser “as is” “with all faults” and Schuler Manufacturing and Equipment Co.,
Inc. makes no express warranties with respect to the truck, other than the express warranty that Schuler
Manufacturing and Equipment Co., Inc. has good and marketable title to the truck and the truck is free and
clear of all liens, encumbrances and security interest. ANY IMPLIED WARRANTIES, INCLUDING BUT NOT
LIMITED TO, THE IMPLIED WARRANTY OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR
PURPOSE, ARE HEREBY ENTIRELY EXCLUDED AND DISCLAIMED. IN NO EVENT SHALL SCHULER
MANUFACTURING AND EQUIPMENT CO., INC. BE LIABLE FOR ANY LOST PROFITS, EXEMPLARY,
SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES WHATSOEVER ARISING OUT OF THE SALE
OF THE TRUCK.
