10.4EXCLUSION

•Normalwearonmobilepartsotherthanfailurescausedbyamanufacturingormaterialdefectthathasbeencorrectly

identied;

•Travellingexpensesforthetrackedvehicle,equipmentandstaffneededforrepairs;

•PartsthatwerenotmanufacturedorprovidedbySoucyInternationalInc.;

•Shopsuppliesandrepairsmadebyathirdparty,otherthantheagentauthorizedbySoucyInternationalInc.;

•Useoftheproductinaeldotherthanagricultureandwintertrailgrooming;exceptwiththeformalwrittenconsent

ofSoucyInternationalInc.;

•Normalwearandtearoflugsduetoprolongedusedonroadsand/orhardsurfacesand/orabrasivesurfacesarenot

deemedwarrantable.PleaserefertotheSoucyTrackOperationManualfordetails;

•Damagecausedbybluntobjects(e.g.cut,partialtearingofrubber,etc.)thatarenottheresultofamanufacturing

ormaterialdefect;

•Damageresultingfromnegligenceorfromamechanicalfailureofthetractor,aswellasdamagecausedbyan

accidentorthespillingofchemicalsonthetrack;

•Damagesseenaspurelyaestheticthatdonothinderthesystemperformanceordurability.

10.5LIMITATIONS

NOTE

SoucyInternationalInc.cannotbeheldresponsibleinthefollowingcases:

•Forindirect,incidental,orconsequentialdamages;

•Fordamagetoatractororimplementorequipmentpiecesdesignedandmanufacturedbyathird-partymanufacturer;

•Foranylossofearnings,orlossofuseofanequipmentpart,causedbyamechanicalfailure;

•WhenSoucyInternationalInc.isnotinformedbytheclientorauthorizedagentofanydefectorfailurewithina

reasonabletimeorduringthewarrantyperiod(pleaserefertothe"TERMS"sectionformoreinformation);

•WhenthefailurewascausedbyaninstallationdeemedinappropriatebySoucyInternationalInc.;

•Whentheproductand/orpartfailureistheresultofabuse,negligenceorinadequatemaintenance;

•WhentheproductwasmodiedinanywaywithouttheimplicitconsentofSoucyInternationalInc.oroneofits

representatives.
