Limited Warranty
THIS IS A LIMITED WARRANTY FOR KODAK SUPER 8 CAMERA
(“Product”). THIS WARRANTY IS ONLY VALID WITHIN THE COUNTRY OF
SALE OF THE PRODUCT. YOU MUST PRESENT THIS FORM TOGETHER
WITH VALID PROOF OF PURCHASE AND PROOF OF PURCHASE DATE
(BILL OF SALE) TO OBTAIN WARRANTY SERVICE.
This Eastman Kodak Company (“Kodak) Product is warranted by Kodak
to be free from defects in material and workmanship for one (1) year from
the date of purchase or usage of a maximum of 100,000 frames shot,
whichever comes irst.
During this warranty period if the Product is found to be defective in
material or workmanship, Kodak or one of its authorized service facilities
will at its sole option, either repair or replace this Product without charge,
subject to the conditions, limitations and exclusions set forth herein. The
option of repair or replacement is Kodak’s only obligation.
1. This warranty extends to the original consumer purchaser only and is
not assignable or transferable.
2. This warranty shall not apply to any Product which has been
subjected to misuse, abuse, abnormal use, excessive use, negligence,
alteration or accident, or has had its serial number altered or removed.
3. This warranty does not apply to any defects or damage directly
or indirectly caused by or resulting from the use of unauthorized
replacement parts, accessories, attachments; service performed
by unauthorized personnel or an unauthorized repair center; failure
to follow Kodak’s operation, maintenance or repacking instructions;
failure to use items supplied by Kodak (e.g., adapters, cables);
circumstances beyond Kodak’s control or claims made after the
duration of this warranty.
4. This warranty does not apply to the batteries and software driver that
accompanies this product, ilm or ilm processing.
5. Warranty Service is only available within the country where the
Products were originally purchased. Customer may be required to
ship Products, at customer’s expense, to the authorized service facility
within the country of purchase.
6. Warranty service will include labor, necessary adjustments and
replacement parts. Replacement parts may be remanufactured or
may contain remanufactured materials. If it is necessary to replace the
entire Product, it may be replaced with a remanufactured Product in
Kodak’s sole discretion and at its option. Remanufactured Products,
parts and materials are warranted for the remaining warranty term of
the original Product or 60 days (up to 16,438 frames) after the date of
repair or replacement, whichever is longer.
THIS WARRANTY IS MADE EXPRESSLY IN LIEU OF ALL OTHER
WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED
TO ANY IMPLIED WARRANTY MERCHANTABILITY OR FITNESS FOR A
PARTICULAR PURPOSE, AND ALL OTHER OBLIGATIONS OF EASTMAN
KODAK COMPANY PROVIDED, HOWEVER, THAT IF THE DISCLAIMER
OF IMPLIED WARRANTIES IS EFFECTIVE UNDER APPLICABLE LAW, THE
DURATION OF ANY IMPLIED WARRANTIES ARISING BY OPERATION OF
LAW SHALL BE LIMITED TO THE SHORTER OF ONE (1) YEAR FROM THE
DATE OF PURCHASE OR 100,000 FRAMES SHOT OR SUCH LONGER
PERIOD AS MAY BE REQUIRED BY APPLICABLE LAW.
Warranty
KODAK HEREBY DISCLAIMS ANY AND ALL LIABILITY FOR SPECIAL,
CONSEQUENTIAL AND INCIDENTAL DAMAGES ARISING OUT OF OR IN
CONNECTION WITH THE SALE, PURCHASE OR USE OF THE PRODUCTS
REGARDLESS OF THE CAUSE, ANY BREACH OF THIS WARRANTY OR
ANY OTHER CLAIM WITH RESPECT TO THIS PRODUCT, INCLUDING BUT
NOT LIMITED TO, CLAIMS OF NEGLIGENCE, STRICT LIABILITY IN TORT
OR BREACH OF CONTRACT.
SOME STATES DO NOT ALLOW (A) LIMITATIONS ON HOW LONG AN
IMPLIED WARRANTY LASTS OR (B) THE EXCLUSION OR LIMITATION
OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE
LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. THIS
WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY
HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE OR BY
JURISDICTION.
In order to obtain performance of the warranty obligations, the original
purchaser must return the Product together with proof of purchase
and proof of purchase date (bill of sale) either in person or addressed to
Kodak’s authorized repair center. Prior to shipping the camera for service,
the camera owner will be required to communicate with a Kodak service
representative who will troubleshoot and determine whether or not a
repair is required. The service representative will provide instructions and
direction upon such determination.
In returning this product for repair or replacement under this warranty,
the original consumer purchaser must prepay all postage, shipping
transportation, insurance and delivery costs, and the product must be
delivered in packaging and shipping materials that aord an adequate
degree of protection. Kodak will not be responsible for any loss or
damage incurred in connection with the return of this product.
THIS WARRANTY WILL BE VALID ONLY WITH AUTHENTIC PRODUCTS
SOLD BY KODAK AND SERVICED THROUGH AN AUTHORIZED REPAIR
CENTER.
