Limitations
Yoursoleandexclusiveremedy
againstPACCARandtheselling
dealerarisingfromyourpurchaseand
useofthisengineislimitedtothe
repairorreplacementof“warrantable
failures”atauthorizedUnitedStates
andCanadianPACCARengine
dealers,oranauthorizedCummins
Distributor,oranauthorizedPACCAR
enginefacilitywhereapplicable,
subjecttoPACCAR'stime,mileage,
andhourlimitationsoftheengine
emissionwarranty.Themaximum
time,mileageandhourlimitationsof
theengineemissionwarrantybegin
runningonthedateofdeliveryto
therstpurchaser.Theaccrued
time,mileage,orhoursiscalculated
whentheengineisbroughtintoan
authorizeddealerforcorrectionof
warrantablefailures.
Failures,otherthanthoseresulting
fromdefectsinmaterialorfactory
workmanship,arenotcoveredbythis
warranty.PACCARisnotresponsible
forfailuresordamageresultingfrom
whatPACCARdeterminestobe
abuseorneglect,including,butnot
limitedto:damageduetoaccident;
operationwithoutadequatecoolantsor
lubricants;overfueling;overspeeding;
lackofmaintenanceoflubricating,
coolingorintakesystems;improper
storage,starting,warm-up,run-inor
shutdownpractices;unauthorized
modicationsoftheengine.PACCAR
isalsonotresponsibleforfailures
causedbyincorrectoil,fuelordiesel
exhaustuidorbywater,dirtorother
contaminantsinthefuel,oilordiesel
exhaustuid.Failureofreplacement
partsusedinrepairsduetotheabove
non-warrantableconditionsisnot
warrantable.
PACCARisnotresponsiblefor
non-enginerepairs,downtime
expenses,cargodamage,nes,all
applicabletaxes,allbusinesscosts
orotherlossesresultingfroma
warrantablefailure.
