inoperativebyanypersonotherthan
forpurposesofmaintenance,repair,or
replacement,ofanydeviceorelement
ofdesignincorporatedintoanynew
vehicleforthepurposeofnoisecontrol
priortoitssaleordeliverytothe
ultimatepurchaserorwhileitisinuse,
or(2)theuseofthevehicleaftersuch
deviceorelementofdesignhasbeen
removedorrenderedinoperativeby
anyperson.
