Cargotec reserves the right to change the designs or specifications
of its products at any time without incurring any liability to carry out
identical or similar changes to products already manufactured, sold
or delivered to any purchaser.
Warranty period
This warranty will remain valid for a maximum of twelve (12) months
from the date of the delivery of the product to the original purchaser
or two thousand (2000) cumulative hours of operation, whichever
occurs first, provided that it shall always expire eighteen (18)
months from the shipment of the product, from Cargotec.
Parts which are replaced or repaired under the warranty will be war‐
ranted likewise for a period of six months from the date of replace‐
ment or repair or until the expiration of the 12 month period as
specified in previous paragraph.
Implementation of the warranty
The warranty covers the repair or replacement (by repaired or new
component) of defective parts, at Cargotec’s option. Any defective
parts that are replaced become the property of Cargotec.
All work to be carried out under this warranty must be performed by
a dealer or service agent, approved in writing by Cargotec. All such
work is to be carried out according to Cargotec’s instructions and
during normal working hours. Where applicable, Cargotec shall
deliver parts covered by warranty, free of charge under terms CIP,
to client’s nearest interna-tional entry. All other costs, for example.
all duties, are to be carried by the client. When parts are required to
be returned to Cargotec, the right to accept return cost in advance,
is reserved.
What the warranty does not cover
Cargotec will not repair or replace any part that: (a) has been dam‐
aged in shipment for which Cargotec is not responsible according to
the applicable delivery conditions; (b) becomes defective as a result
of an accident after delivery to the orig-inal purchaser, improper or
unauthorized service, overloading, carelessness or improper stor‐
age, handling or use; (c) becomes defective as a result of normal
wear and tear; (d) becomes defective as a result of the use of spare
parts which were not supplied by Cargotec ; (e) otherwise has been
used, maintained or serviced in a manner not consistent with Cargo‐
tec’s instruction manual and maintenance instructions; or (f) the
conditions for the applicability of the warranty as set out above,
have not been met.
This warranty does not cover routine mechanical adjustments such
as are described and explained in the instruction manual and main‐
tenance instructions furnished to the original purchaser. Such
adjustments are the responsibility of the owner.
Cargotec shall not be liable for special, indirect, incidental or conse‐
quential damages, whether in contract, warranty, tort, negligence,
strict liability or otherwise including, but not limited to, travel expen‐
ces, allowances and shipment costs, loss of use of the product, loss
of profits or revenue, damage to other property, delays, or claims of
