customers or other third parties for such or other damages. Yard
recovery, towing and transportation costs to workshops are not cov‐
ered.
Under all circumstances the liability of Cargotec for any damages,
shall be limited to the purchase price for the product.
Notwithstanding the before mentioned provisions, Cargotec’s man‐
datory liability under any applicable law relating to product liability,
as in effect from time to time, remains unchanged.
Cargotec does not accept any liability for promises or warranties
relating to the product and its parts, extending Cargotec’s liability
beyond the conditions clearly expressed in this warranty.
Reporting of defects
It is the responsibility of the owner of the product to report any non‐
conformity under this warranty in writing to either Cargotec or an
authorized dealer or service agent of Cargotec. All defects must be
reported as soon as possible, but in no case later than fourteen (14)
days after the owner first discovered such defect or ought to have
discovered the defect and claimed within two months.
Any reported defect, shall be inspected and confirmed by technical
personnel from an authorized dealer or service agent of Cargotec, if
not otherwise agreed in writing.
Major component warranty coverage
The following are covered by their own manufacturer’s warranty.
The owner must contact them directly for warranty work. Cummins,
Allison, Volvo, Siemens, ABB, and Control Techniques Drive Serv‐
ice.
Warranty coverage for large components (e.g. engines, transmis‐
sions, generators, inverters, electrical drive- and hoist motors) is
based on original component manufacturer’s warranty terms and
conditions.Contact your local Kalmar repre-sentative with any ques‐
tions regarding component warranties.
Governing law
This warranty shall be governed and interpreted in accordance with
the laws of Finland, excluding, however, the provisions contained in
the Finnish Act (796/1988) on International Sales of Goods.
If, due to any mandatory rule in any applicable law, some part of this
warranty should not be governed by and interpreted in accordance
with the Finnish law, this shall in no way affect the applicability of
Finnish law with respect to other parts of this warranty.
