high-voltage battery. The com-
mitments do not apply if a defect
of the high-voltage battery or an
excessive loss of capacity is due
to accident damage or has oc-
curred because
the BMW C evolution vehicle
was operated under condi-
tions for which it was not ho-
mologated (e.g. in a country
with conditions of homologa-
tion different from that of the
place of initial delivery), or
the BMW C evolution was
handled incorrectly or over-
strained, for example in motors-
port competition, or
parts were installed in the
BMW C evolution vehicle the
use of which the manufacturer
had not approved, or the
BMW C evolution vehicle of
parts thereof (e.g. software)
were modified in a way
not authorised by the
manufacturer, or
the instructions for handling,
maintenance and care of the
BMW C evolution vehicle
(particularly as set out in the
Rider's Manual) were not
followed, or
the high-voltage battery was
opened or removed from the
BMW C evolution vehicle.
7. This BMW C evolution Bat-
tery Certificate is a supplement-
ary part of the terms and condi-
tions of sale and supply for new
BMW C evolution vehicles. Com-
mitments and claims in accord-
ance with the terms and condi-
tions of sale and supply for new
BMW C evolution vehicles are
unaffected by the commitments
set out in this BMW C evolution
Battery Certificate.
8. A change of owner of the
BMW C evolution vehicle does
not affect the commitments set
out in the BMW C evolution Bat-
tery Certificate.

Austria, Belgium, Germany,
France, Great Britain, Ireland,
Italy, Liechtenstein, Luxembourg,
Monaco, Netherlands, Portugal,
San Marino, Spain, Switzerland.
