Statement of Limited Warranty
This limited Warranty is provided by Carlos Mainero y Cía. S.A.I.C.F.I. (“MAINERO”) only to the original purchaser of
the Product from MAINERO or authorized MAINERO dealers (the “Purchaser”).
1.- WARRANTY VALIDITY REQUIREMENT
In order to validate this Warranty Certicate, the Purchaser must promptly submit the Technical Delivery Declaration
to “Carlos Mainero y Cía. S.A., Customer Service”, Rivadavia Nº 259, Bell Ville X2550DZE, Republic of Argentina,
within fteen (15) consecutive days from the date of the technical delivery of the Product.
Timely submission of the Technical Delivery Declaration is a basic and indispensable condition for this Warranty to
be enforceable. Accordingly, Purchaser’s failure to comply with the foregoing requirement will imply that this Warranty
shall be deemed unenforceable against MAINERO, and result in forfeiture by the Purchaser of its rights hereunder by
the mere course of the aforesaid remission term.
By sending the Technical Delivery Declaration to MAINERO, the Purchaser expressly agrees with all the terms and
conditions set forth in this Warranty.
2.- SCOPE AND PERIOD OF WARRANTY
MAINERO warrants that all pieces, assemblies and accessories (the “parts”) of the Product of its manufacture will be
free from manufacturing defects in material and workmanship (under normal use) for a period of six hundred (600)
operating hours or one hundred and eighty (180) consecutive days (whichever comes rst) as of the date recorded on
the Technical Delivery Declaration.
3.- OBLIGATION OF MAINERO
Subject to the conditions, exclusions and limitations herein, if during the effective warranty period any MAINERO genui-
ne part of the Product covered by this Warranty is found to be defective in material and/or workmanship (under normal
use), MAINERO will, at its sole option, either repair the defective part or replace it with a new genuine part, without
charge to the Purchaser for the part or labor.
MAINERO’S TOTAL LIABILITY UNDER THIS WARRANTY IS LIMITED TO REPAIR OR REPLACEMENT OF DEFEC-
TIVE PARTS IN MATERIAL AND/OR WORKMANSHIP. REPAIR OR REPLACEMENT ARE THE PURCHASER’S SOLE
AND EXCLUSIVE REMEDIES FOR BREACH OF WARRANTY OR ANY OTHER APPLICABLE LEGAL THEORY. TO
THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MAINERO BE LIABLE FOR
CONSEQUENTIAL, INCIDENTAL, DIRECT, INDIRECT OR SPECIAL DAMAGES, OR FOR WHATSOEVER CONSE-
QUENCES ARISING FROM SUCH DAMAGES, SUCH AS, BUT NOT LIMITED TO, LOSS OF USE, LOSS OF PRO-
FITS, LOSS OF SALES, LOSS OF OPPORTUNITY, INJURY TO GOODWILL, TRAVEL ALLOWANCES, FEES FOR
PHONE CALLS, LOSS OF TIME, INCONVENIENCE, OR ANY OTHER INCIDENTAL OR CONSEQUENTIAL DAMA-
GE ARISING FROM THE PURCHASE, USE OR INABILITY TO USE THE PRODUCT INCLUDING ANY INJURY TO
PERSON OR DAMAGE TO PROPERTY, EITHER TO THE OWNER, USER OR THIRD PARTIES, EVEN IF MAINERO
HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
WHENEVER POSSIBLE, EACH PROVISION OF THIS WARRANTY SHALL BE CONSTRUED SO AS TO BE EFFEC-
TIVE AND VALID UNDER ANY APPLICABLE LAW. IF ANY PROVISION OF THIS WARRANTY SHALL BE PROHIBI-
TED BY OR DETERMINED INVALID UNDER ANY APPLICABLE LAW, SUCH PROVISION SHALL BE INEFFECTIVE
ONLY TO THE EXTENT SUCH PROHIBITION OR INVALIDITY, WITHOUT INVALIDATING THE REMAINDER OF
SUCH PROVISION OR OTHER PROVISIONS CONTAINED IN THIS WARRANTY.
THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS
WHICH VARY FROM JURISDICTION TO JURISDICTION.
4.- EXCLUSIONS FROM COVERAGE
Esta Garantía NO CUBRE:
a.- Non-MAINERO parts included in the Product, such as roller chains, bearings, etc. Warranty claims related to non-
MAINERO parts will be resubmitted, together with defective parts, to the original manufacturer for analysis and
approval. MAINERO does not respond or guarantee the decisions taken by original manufacturers.
b.- Shipping and/or transport costs, handling costs, labor costs or other expenses whatsoever related to the delivery of
defective parts to and from MAINERO for their analysis, and repair or replacement.
c.- Maintenance services of the Product, as well as all necessary supplies for their performance.
d.- At MAINERO’s sole discretion, all kinds of damage, breakdown or deterioration whether to the Product or its parts,
caused by or resulting from:
• normal wear and tear.
• misuse, abuse or neglect (such as overloads, damages due to continued operation of the Product after a defect
or breakdown is or should have been discovered, and the like).
Warranty Certicate
