VOLCON BRAT OWNER’S MANUAL
pg. 65
WHAT ARE YOUR REMEDIES UNDER THIS LIMITED WARRANTY?
If Volcon determines that the defective Covered Component or battery is covered
by the limited warranty, Volcon will, at its sole discretion, directly or through one of its
certied service centers or dealerships, replace the defective Covered Component
or battery (as applicable). Labor for replacement is NOT covered under warranty
and is the responsibility of the owner or claimant. Transportation to and from
certied service center, authorized Volcon dealer or retail location in the United
states for the purpose of replacement is solely responsibility of owner or claimant.
If Volcon elects to repair the defective Covered Component or battery, you will
be responsible for transporting the bike to an authorized Volcon dealer or service
center in the United States for repair. In case of authorized repair, labor cost is
only covered through a Volcon authorized dealer or service center. You do have
the right to have repair done at a retail location, of your choice, at your expense.
Volcon will be responsible for standard, domestic shipping costs associated with shipment
of any replacement Covered Components or batteries to you. In the event Volcon agrees to
ship any replacement Covered Components or batteries to you overnight or to an international
location, you will be responsible for all costs above standard shipping costs associated
therewith (including, without limitation, all costs associated with any international shipments).
THE REMEDIES ABOVE ARE YOUR SOLE AND EXCLUSIVE REMEDIES, AND
VOLCON’S ENTIRE LIABILITY, FOR BREACH OF THE LIMITED WARRANTY.
VOLCON’S LIABILITY SHALL UNDER NO CIRCUMSTANCES EXCEED THE ACTUAL
AMOUNT PAID BY YOU FOR THE BIKE. IN NO EVENT SHALL VOLCON UNDER
ANY CIRCUMSTANCES BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL,
SPECIAL, OR PUNITIVE DAMAGES OR LOSSES, WHETHER DIRECT OR INDIRECT.
SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL
OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY
NOT APPLY TO YOU.
