Those that are being used, but have not yet completed the registration process.
Both categories are protected, although those that are registered provide visible notice of the
corporation’s rights and stronger enforcement provisions.
The registration process may take a long period of time before it is finalized, thus pending
trademarks, service marks, and tradenames may be in use by the corporation.
Trademarks, service marks, and tradenames must be used with the first mention or most
prominent appearance in a publication, but need not be used with each subsequent appearance.
If there are multiple uses of trademarks, service marks, and tradenames throughout the
publication, an explanatory note on the cover sheet is sufficient.
