5. INSPECTION AND MAINTENANCE
5.1 Warranty
One-Year Limited Warranty
The seller warrants this product to be free from defects in material and workmanship
under the normal use of this product for one (1) year or other term complying with local
regulations from the date of invoice issued by Seller to the original purchaser.
Lamps, paper and other consumable items shall not be covered by this warranty.
This warranty also shall NOT apply if the product has not been installed, operated or
maintained in accordance with the INSTRUCTION MANUAL of Tomey Corporation
(here in after called “Tomey” ). Neither seller nor Tomey shall be liable for any damages
caused by purchaser's failure to
follow instruction for proper installation, use and maintenance of product.
This warranty is only applicable to the new product and DOES NOT cover any damage
resulting from or caused by accident or negligence, abuse, misuse, mishandling,
improper modication of this product, by persons other than personnel duty authorized
by Tomey, not to a product whose serial number or batch number is removed, altered or
effaced.
THIS WARRANTY IS EXPRESSLY IN LIEU OF ANY AND ALL OTHER WARRANTIES,
EXPRESS OR IMPLIED (INCLUDING SPECIFICALLY, WITHOUT LIMITING THE
GENERALITY OF THE FOREGOING, ALL WARRANTIES OF MERCHANTABILITY
AND FITNESS FOR A PARTICULAR PURPOSE), AND ALL OTHER OBLIGATION
AND LIABILITY ON THE PART OF SELLER AND TOMEY. NEITHER SELLER NOR
TOMEY SHALL BE LIABLE FOR INCIDENTAL, CONSEQUENTIAL OR SPECIAL
DAMAGES UNDER ANY CIRCUMSTANCES OR FOR MORE THAN REPAIR,
REPLACEMENT OR REFUND OF THE PURCHASE PRICE OF DEFECTIVE GOODS.
