Waratahwarrantseachnewattachmenttobefree
offailureresultingfromdefectivematerialand/or
workmanship,underproperuseandserviceforaperiodof
one(1)yearortwothousand(2000)hours,whicheverrst
occurs,followingthedateofdeliveryoftheattachmentto
theoriginalretailcustomer(user).
Inordertovalidatethiswarranty:allprescribed
pre-deliveryandstart-upinspectionsmustbecomplete;a
complete,signed,copyoftheWarrantyRegistrationForm
mustbesubmittedtothesellingWaratahDistribution
Centre(WDC).
Attachmentsmayonlybeusedfortheirdesignated
purpose,asdenedinWaratah’stechnicalandmarketing
publications.
Waratah’ssoleobligationunderthiswarrantyislimitedto
therepairorreplacement,withoutcharge,atWaratah’s
warehouse,oranapprovedrepairshop.Whereanyparts
areidentiedasdefectiveinmaterialorworkmanship,the
usermustpre-payanyreturnfreightcosts.
Waratahisnotresponsibleforanycostsassociatedwith
thedeliveryoftheattachmenttoanauthorisedrepair
shop,noranycostsassociatedwiththedeliveryofparts
tomaketherepairs.
Thiswarranty,initsentirety,doesnotcovermaintenance
itemsusedinservicingWaratahproducts,whichinclude,
butarenotlimitedto:feedrollers;lters;lubricating
grease;andoils.
Partsnotcoveredbythiswarrantyincludethose
showingevidenceof:neglect;overload;abuse;accident;
inadequatemaintenance;orunauthorisedalteration.
Thiswarrantyshallbevoidifrepairsoralterationsto
aWaratahattachmenthavebeenmadebypersonsor
rmsnotspecicallyapprovedbyWaratahsoasto,in
Waratah’sopinion,adverselyaffecttheattachment’s
performanceorreliabilityinanyway.
Theinstallationofanyproductorattachmentnot
specicallyapprovedbyWaratah,orfailuretouseonly
Waratah-approvedreplacementparts,shallalsovoidthis
warranty.
LiabilityorobligationonthepartofWaratahfordamages,
whethergeneral,special,orfornegligence,andexpressly
includinganyincidentalandconsequentialdamages,
isherebydisclaimed.Waratah’sobligationtorepairor
replaceshallbethelimitofitsliabilityunderthiswarranty
andthesoleandexclusiverightandremedyoftheuser.
Thiswarrantyisexpresslyinlieuofallotherwarranties,
expressedorimpliedinwrittenororalform,including,
withoutlimitation,anyimpliedwarrantiesoftnessfora
particularpurposeorofmerchantability.
Thiswarrantymaynotbechanged,altered,ormodiedin
anyway,exceptinwritingbyWaratah.
Avoidunauthorisedmachinemodications
ChangesofanykindtothisWaratahproduct,including
thettingofanyunauthorisedattachments,couldaffect
theintegrityoftheproduct,oritsabilitytoperformas
designedorintended.
NochangesshouldbemadetoanyWaratahproduct,
includingdeletionsoradditions,otherthanoptions
approvedbyWaratah,whicharettedinamanner
approvedbytheWaratahfactory.
Optionsorchangesareonlyofciallyapprovedinthe
followingform:

Standardoptionsforthatproductshownorlistedon
acurrent,Waratah-produced:printedspecications
sheet;pricelist;partsmanual;orotherproductlitreature.

Nootherpersonisauthorisedtogivesuchapproval.
Waratahdisclaimsresponsibilityforanysituationarising
asaresultofanyunauthorisedchangetoitsproduct,such
astheuseofanon-approvedsawbarorchain-tensioner
installedonaWaratahharvesterhead.Ifanypersonor
organisationmodies,orcontributesinanywaytoan
unauthorisedmodication,thepersonororganisationwill
bedeemedtohaveassumedtheriskinvolvedwithsuch
modication,andmaybedeemednegligentincreatinga
dangeroussituationresultingfromsuchaction.
WherechangesaremadewithoutWaratah’sofcial
approval,andWaratahbecomesinvolvedinasuitarising
outofsuchachange,Waratahwillprotectitsinterestby
takingappropriateaction.
Failuretoadheretothispolicynulliesandvoidsthe
product’swarranty,aswellasthecerticationonanysafety
itemsinstalledonthemodiedmachineorattachment.
Non-approvedproductchangesalsonullifywarranties
giventoWaratahbyitscomponentmanufacturers.
