Liability Clause:
In all cases in which I.E.M. GmbH is liable resulting from contractual or legal
claims for damages or compensation, I.E.M. is only liable if it, or its manag-
ing employees or representatives acted intentionally or in a grossly negli-
gent way. This does not apply to independent liability according to product
liability acts. Also it does not apply to the liability from culpable breaches of
essential contractual obligations, but the liability is insofar restricted to the
predictable, contract-typical damages, except for cases as in 1 and 2.
A change of the burden of proof to the disadvantage of the customer is
not associated with the above regulations. The above mentioned terms do
not apply to the liability for characteristic and durability warranties or upon
deceit and fraudulent concealment.
