Software Copyright
The software program (“Software”) included with your HFA3 is a proprietary product of ZEISS and in
certain instances contains material proprietary to Microsoft Corporation and other third-party
licensors, suppliers and vendors. These proprietary products are protected by copyright laws and
international treaty. You must treat the software like any other copyrighted material. Copyright

End User Software License Agreement
This End User Software License Agreement (“Agreement”) is a legal contract between the Purchaser
(“You”, “Your” “Licensee”) and ZEISS governing Your use of the Software. Opening the sealed
package indicates Your acceptance of the terms and conditions of this License. If You have any

License Terms and Conditions
This End User Software License Agreement (“Agreement”) is between you (both the individual
installing the Software and any single legal entity on behalf of which such individual is acting)
(“You” or “Your”) and Carl Zeiss Meditec, Inc. (“ZEISS”).
BY INSTALLING NEW SOFTWARE ON YOUR EXISTING HFA3, OR BY CREATING DATA ON A NEW
HFA3 THAT ALREADY CONTAINS NEW SOFTWARE, YOU ALSO AGREE TO BE BOUND BY THIS
AGREEMENT. IF YOU DO NOT AGREE WITH ALL THE TERMS OF THIS AGREEMENT AND DO NOT
AGREE TO BE BOUND BY THIS AGREEMENT, THEN DO NOT INSTALL NEW SOFTWARE ON ANY
EXISTING HFA3 YOU MAY OWN, NOR OPERATE ANY NEW HFA3 YOU MAY OWN THAT ALREADY
CONTAINS NEW SOFTWARE. IF YOU DO NOT ACCEPT THIS AGREEMENT, YOU WILL NOT HAVE THE
RIGHT TO USE OR ACCESS THE PROGRAMS.
In consideration of the mutual promises contained herein, and other good and valuable
consideration, the receipt and adequacy of which are hereby acknowledged by each party, the
parties mutually agreed as follows:

EFINITIONS
1.1 “Documentation” means the user guides for installation and use of the
Software (including read-me files, notice files, and installation details) or the hardware on which the
Software operates.
1.2 “Software” means the software provided by ZEISS and ZEISS’ third party
licensors (“Third Party Licensors”) for use in connection with HFA3, in object code form or, only if
provided as part of the Third Party Licensor’s standard shipment of the Software in source code
form, including any operating systems and integrated software, and the media, Documentation and
any updates and upgrades provided by ZEISS or the Third Party Licensors to which You are granted
a license from ZEISS pursuant to this Agreement.
