Warranty Information
Below, you will find the Avalex Technologies warranty policy. For information on customer
service and technical support, see the following technical support section.
LIMITED WARRANTY: Avalex Technologies makes NO WARRANTIES OF MERCHANTABILITY,
OR FITNESS OF A PARTICULAR PURPOSE, or any other warranties of quality, product
performance, or Buyer satisfaction, whether EXPRESS or IMPLIED except as to title AND as
set forth herein:
Avalex Technologies warrants that the Products are free from defects in material and
workmanship. Upon notice of any defect in material and workmanship, Avalex Technologies
shall have the right to inspect the Products and to investigate all claims for the purpose of
determining whether the Products are defective. If Avalex Technologies determines that the
Products are defective and covered by this limited warranty then Avalex shall, at its option,
have the right either to repair or replace any Products. No Products shall be returned without
Avalex Technologies’ prior written consent.
The warranty contained herein shall be conditioned upon (i) Customer’s substantiation that the
Product(s) have been stored, maintained, and operated in accordance with the Product
specifications and standard industry practice and have not been damaged as a result of
negligence, improper handling, or accident on the part of any person, (ii) Customer’s payments
of all invoices for the Products or other charges to which Avalex Technologies may be entitled,
(iii) Customer’s exclusive use of persons approved or authorized by Avalex Technologies to
effect any repairs to the products, and (iv) Customer’s substantiation that no modification or
alteration of the Products have been made.
Subject to the foregoing, Avalex Technologies warrants products to be free from defects in
materials and workmanship for 12 months from date of shipment. Avalex Technologies will, in
its sole discretion, repair or replace any components which fail in normal use. Such repairs or
replacement will be made at no charge to Buyer for parts and labor.
Avalex Technologies warrants repaired Products to be free from defects in materials and
workmanship for 90 days from date of repair. Repairs completed under warranty at no cost to
Buyer will not extend original warranty period on the Product. Avalex Technologies will, in its
sole discretion, repair or replace any components which fail in normal use. Such repairs or
replacement will be made at no charge to Buyer for parts and labor.
Customer is responsible for all transportation costs to Avalex Technologies and redelivery to
Customer. Avalex Technologies will return the product to the customer at Customer’s expense
by the most economical method.
The warranty contained in this section is in lieu of and excludes all other warranties, express or
implied, by operation of law or otherwise, including any implied warranty of merchantability or
