fitness for a particular purpose. Loss or damage arising out of or in any way related to the
manufacture, sale, delivery or use of the products shall be as provided herein and shall in no
case exceed the lesser of the cost of repair or replacement. In no event, shall Avalex
Technologies be liable for special, incidental, or consequential damages, even if it has reason
to know in advance that such damages are possible. This warranty does not cover failure due
to abuse, misuse, accident, or unauthorized alterations or repairs and covers only material
defects that appear under normal use. Avalex Technologies’ liability and Customer’s exclusive
remedy for defective Products shall be limited solely to repair or replacement.
This warranty is non-transferrable and non-assignable and may be enforced only by the
original Buyer. Warranties are not transferable.
